Each bid must be accompanied by a certified or cashier's check from an Oklahoma bank or a bidder's bond for 5% of the bid amount as a guarantee of performance and commitment to enter a contract. Bidders must also submit DW-412 Noncollusion and DW-413 Business Relationships affidavits, demonstrating there has been no collusion or improper agreements related to the bid. Performance, maintenance, and statutory payment bonds for 100% of the contract price are required with a corporate surety licensed in Oklahoma and approved by the owner and engineer. A maintenance bond covering repairs due to improper materials or workmanship for one year after acceptance is also required. This project is funded by ARPA, EPA, and local sources.
