Each bidder and all subcontractors must be licensed contractors pursuant to the California Business and Professions Code and must be licensed to perform the work specified in the contract documents, with License Classification: B. Each bid must strictly conform with and be responsive to the contract documents as defined in the General Conditions. The designated subcontractors on this project must be listed as required by the Subletting and Subcontracting Fair Practices Act, California Public Contract Code Sections 4100 et seq. Each bid must be accompanied by a bidder's security in an amount not less than ten percent (10%) of the total bid price. Acceptable forms of bidder's security include: cash, a cashier's check, a certified check, or a bidder's bond executed by a California admitted surety, made payable to the District in the form set forth in the contract documents. Contractors and subcontractors must pay no less than the prevailing rate of per diem wages as required by the California Labor Code, including holiday and overtime work and employer payments for health and welfare, pension, vacation, and similar purposes. No contractor or subcontractor will be qualified to bid or engage in performance pursuant to the Labor Code unless currently registered and qualified to perform public work pursuant to Labor Code section 1725.5. If the Project includes work by mechanical, electrical, or plumbing (MEP) subcontractors with certain license classifications (C-4, C-7, C-10, C-16, C-20, C-34, C-36, C-38, C-42, C-43, or C-46), those MEP subcontractors must also be prequalified. A list of prequalified MEP subcontractors will be made available by the District. It is the bidder's responsibility to ensure all MEP subcontractors are properly prequalified before submitting a bid. No bidder may withdraw a bid for ninety (90) calendar days after the bid opening. Separate payment and performance bonds, each equal to 100% of the contract amount, are required and must be issued by a California admitted surety. Goals and requirements related to Disabled Veteran Business Enterprises (D.V.B.E.) participation also apply. The District permits the substitution of securities for any moneys withheld to ensure contract performance, in accordance with California Public Contract Code Section 22300.
