The tender bond must be issued by a financial institution that is an insurer holding a licence issued in accordance with the Insurance Act (R.S.Q., c.A-32) authorising it to carry on surety insurance business, a trust company holding a licence issued under the Trust and Savings Companies Act (R.S.Q., c. S-29.01), a financial services cooperative governed by the Financial Services Cooperatives Act (R.S.Q., c. C-67.3) or a bank within the meaning of the Bank Act (S.C., 1991, c. 46). Where the tender guarantee takes the form of a bond, it must be accompanied by a letter of undertaking issued by the issuer of the bond stating that a performance bond and a bond for obligations relating to supplies, materials and services will be provided to the successful tenderer. Where guarantees take the form of a bond, the amount of each shall be equal to fifty per cent (50%) of the contract price.
