Establish a Statewide Price Agreement for gravel and landscaping materials. This is a MATERIALS AND DELIVERY price agreement. It may be utilized by all New Mexico State Agencies, commissions, political subdivisions and local public bodies applicable by law. The purchaser will further be known as the "Department" or "State" in this Price Agreement. The term of this Price Agreement shall be for one (1) year from date of award with the option to extend for a period of three (3) additional years, on a year-to-year basis, by mutual agreement of all parties and approval of the New Mexico State Purchasing Agent at the same price, terms and conditions. This Price Agreement shall not exceed four (4) years. The Department reserves the right to purchase material from any of the contractors awarded based on the needs of the Department. Orders shall be placed by the department engineer or a designee. This designee of user agency will determine and use the Price Agreement item which best services the Department's needs, based on the cost, delivery time, schedule of work and quality of material. All decisions made by designee of Department will be final.
