In lieu of posting the bond , a bidder may use a Cashier's Check , Certified Check or Letter of Credit for ten percent of the Contractor's bid as bid security . When a check or letter of credit is used , the bidder shall be required to post a 100 percent Performance Bond and a 100 percent Labor and Material Payment Bond , upon the signing of the contract . The Owner (s ) reserves the right to reject any and all bids , and the right to accept the lowest and best bid , the right to waiver minor irregularities on any bid , and the right to accept the bid proposal which promotes the best interest of the Owner (s ).
