Bids must be accompanied by a signed bid bond equal to ten percent (10%) of the bid amount, in the form of a certified check, a promissory note, an irrevocable letter of guarantee, or a surety bond. The bid bond must be issued by a financial institution that is an insurer holding a license issued in accordance with the Insurance Act (R.S.Q., c.A-32) authorizing it to conduct surety insurance business, a trust company holding a license issued under the Trust and Savings Companies Act (R.S.Q., c. S-29.01), a financial services cooperative governed by the Financial Services Cooperatives Act (R.S.Q., c. C-67.3), or a bank within the meaning of the Bank Act (S.C., 1991, c. 46). When the bid bond is in the form of a surety bond, it must be accompanied by a letter of commitment issued by the surety stating that a performance bond and a bond for obligations relating to liens, materials, and services will be provided to the successful bidder.
