Pre-Qualification for Bidders: Not Required Project Duration: 240 Work Days This project involves the removal and replacement of existing sanitary sewer mains, the reconnecting of sewer laterals, lining of manholes, and replacement of manholes located at various locations in the Jewel Box area within the City of Capitola, along with appurtenant site improvements. Each bidder must submit a proposal to the Department of Public Works on the standard forms enclosed. Said proposal shall be accompanied by cash, a cashier's check, a certified check or bidder's bond of ten percent (10%) of the amount of the bid submitted, to be made payable to the County of Santa Cruz. Bidder's bonds shall be issued by a corporate surety duly admitted and authorized to issue bonds and undertakings by the State of California. In accordance with Labor Code 1771.1, the Owner hereby advises all bidders that the following apply to bids issued March 1, 2015 or later and contracts awarded April 1, 2015 or later: 1) A contractor or subcontractor shall not be qualified to bid on, be listed in a bid proposal, subject to the requirements of Section 4104 of the Public Contract Code, or engage in the performance of any contract for public work, as defined in this chapter, unless currently registered and qualified to perform public work pursuant to Section 1725.5. 2) It is not a violation of this section for an unregistered contractor to submit a bid that is authorized by Section 7029.1 of the Business and Professions Code or by Section 10164 or 20103.5 of the Public Contract Code, provided the contractor is registered to perform public work pursuant to Section 1725.5 at the time the contract is awarded. 3) This project is subject to compliance monitoring and enforcement by the Department of Industrial Relations (DIR). 4) The Owner will provide notice to the DIR of the award of this Contract within five (5) days of Award. 5) For contracts dated April 1, 2015 or later, the successful bidder shall submit electronic certified payroll records required under California Labor Code Section 1776 to the Labor Commissioner pursuant to California Code of Regulations Chapter 8, Section 16404. The work to be performed under the Contract Documents requires that the Contractor possess a Class "A" license at the time that this contract is awarded. The bidder shall be licensed under the provisions of Chapter 9, Division 3, of the Business and Professions Code of the State of California to do the type of work contemplated in the "contract documents" and shall be skilled and regularly engaged in the general class or type of work called for under this contract. The Santa Cruz County Sanitation District and its Board of Directors reserve the right to reject any or all bids received as the public good may require. The Santa Cruz County Sanitation District hereby notifies all bidders that it will affirmatively ensure that in any contract entered into pursuant to this advertisement, disadvantaged business enterprises will be afforded full opportunity to submit bids and will not be discriminated against on the grounds of race, color, religion, gender or national origin in consideration for an award. The Contractor shall forfeit, as penalty to the Santa Cruz County Sanitation District, Fifty Dollars ($50.00) for each calendar day or portion thereof, for each workman paid less than the stipulated prevailing rates for any work done under the contract by it or by any subcontractor under it, in violation of the provisions of such Labor Code. Pursuant to Section 22300 of the Public Contract Code, the Contractor may substitute a deposit of securities in lieu of the Santa Cruz County Sanitation District withholding any monies to ensure Contractor's performance under the Contract, or alternatively, request that the Santa Cruz County Sanitation District make payment of retentions earned directly to an escrow agent at the expense of Contractor. The provisions of Public Contract Code Section 22300 are incorporated herein by reference as though set forth in full, and shall govern the substitution of securities and/or escrow account.
