The city manager shall announce the results of the bidding, together with his recommendations thereon, to the Council at its meeting to be held at 6:00 PM local time on September 24th, 2019 at the Council Chambers in the City Hall, 515 Clark Avenue, Ames, Iowa, at which time and place the City Council will hear objections to the proposed plans, specifications, and form of contract for said Munn Woods Sanitary Sewer Access Improvements. for work in accordance with the plans and specifications now on file in the office of the city clerk. The City of Ames Public Works Department is the only authorized source of bidding documents and proposal forms. Bidding documents and proposal forms obtained from any other source may have an incomplete set of documents. Bidders using bidding documents and/or proposal forms not obtained from the City of Ames Public Works Department are advised to contact the City of Ames Public Works Department to provide a contact name, mailing address and phone number to enable receipt of necessary addenda. Reproduction of these documents without the express permission of the City of Ames and WHKS & Co. is prohibited. The general nature of the work on which bids are requested is: rehabilitation of 10,000 LF sanitary sewer ranging 8"- 18" diameter and 50 sanitary manholes, and construction of access improvements at Munn Wood and Emma McCarthy Lee Park in Ames. Work includes CIPP lining, cementitious lining, casting/chimney repairs, grading and construction of access improvements, surface restoration, and miscellaneous related work and appurtenances in accordance with the contract documents. All bids shall be submitted to said City Clerk on or before the time set herein for the bid opening. The envelope included with the bid documents may be used to submit your bid. Each bidder shall accompany its bid with bid security as defined in Code of Iowa Section 26.8 and as specified in the Instructions to Bidders. The City of Ames reserves the right to defer acceptance of any bid for a period not to exceed sixty (60) days after receipt of bids, and no bid may be withdrawn during this period. Each successful bidder shall be required to furnish a corporate surety bond in an amount equal to one hundred percent (100%) of its contract price. Said bond to be issued by a responsible surety approved by the City Council and shall guarantee the faithful performance of the contract and the terms and conditions therein contained and shall guarantee the prompt payment of all material and labor, and protect and save harmless the City from claims and damages of any kind caused by the operations of the contract and shall also guarantee the maintenance of the improvement in good repair for a period of two (2) years from and after the completion and acceptance by the City. The guaranteed maintenance period shall be four (4) years for new paving Work shall commence as soon as possible after award, approval of contract and performance bond and shall be completed no later than NOVEMBER 27, 2020. Should the contractor fail to complete the work by this date, liquidated damages of $1,000 per calendar day will be assessed for work not completed within the designated contract completion date. The contractor shall not include sales or use taxes in the bid. Pursuant to Iowa Code and Iowa Administrative Code, the contractor will be authorized to purchase building materials that will be incorporated into real property on this project tax-free. Iowa Construction Sales Tax Exemption Certificates will be issued by the City which will authorize suppliers of building materials to sell materials exempt from Iowa sales tax and any applicable local option sales tax and school infrastructure local option sales tax to the entity listed on the certificate. Upon award of the contract, the successful contractor will be required to provide project information on the contractor, and each subcontractor and supplier requiring the exemption certificates. By virtue of statutory authority, preference will be given to products and provision grown and coal produced within the State of Iowa, and to Iowa labor, to the extent lawfully required under Iowa statutes. In accordance with Iowa statutes, a resident bidder shall be allowed a preference as against a nonresident bidder from a state or foreign country if that state or foreign country gives or requires any preference to bidders from that state or foreign country, including but not limited to any preference to bidders, the imposition of any type of labor force preference, or any other form of preferential treatment to bidders or laborers from that state or foreign country. The preference shall be equal to the preference given or required by the state or foreign country in which the nonresident bidder is a resident. In the instance of a resident labor force preference, a nonresident bidder shall apply the same resident labor force preference to a public improvement in this state as would be required in the construction of a public improvement by the state or foreign country in which the nonresident bidder is a resident. Bidders will be required to complete a Bidder Status Form from the Iowa Department of Labor regarding the Contractor's resident status within the State of Iowa. Failure to submit a fully completed Bidder Status Form with the bid may result in the bid being deemed nonresponsive and rejected. The City of Ames, Iowa in accordance with Title VI of the Civil Rights Act of 1964, 78 Stat. 252, 42 U.S.C. 2000d 4 and Title 49, Code of Federal Regulations, Department of Transportation, Subtitle A, Office of Secretary, Part 21, Nondiscrimination in Federally assisted programs of the Department of Transportation issued pursuant to such Act, hereby notifies all bidders that it will affirmatively insure that in any contract entered into pursuant to this advertisement, minority business enterprises will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, national origin, sex, age, or disability in consideration for an award. The City does hereby reserve the right to reject any or all bids, to waive informalities, and to enter into such contract, or contracts, as it shall deem to be in the best interest of the City
