Bid Security, Performance and Payment Bonds are required for this project. No Bid shall be considered or accepted by the City of Raleigh unless at the time of its filing the same shall be accompanied by a bid security deposit with the City of Raleigh of cash, or a cashier's check or a certified check drawn on a bank or trust company insured by the Federal Deposit Insurance Corporation, in an amount equal to not less than five percent of the Proposal. In lieu of making the deposit as above provided, such Bidder may file a Bid Bond executed by a corporate surety licensed under the laws of the State of North Carolina to execute such bonds; conditioned that the surety will upon demand forthwith make payment to the City of Raleigh upon said Bond if the Bidder fails to execute the Contract in accordance with the Bid Bond. If upon acceptance of his Bid, a Bidder fails to enter into a Contract with the City of Raleigh, the Bid deposit shall be forfeited to and become the property of the City of Raleigh. A separate performance bond and payment bond each in an amount equal to one hundred percent of the Contract price will be required after bids are received and the Notice of Award has been issued to the lowest most responsive, responsible bidder.
