For the furnishings of materials, labor and equipment, under the plans and specifications as set out to accomplish the pre-excavation of USACE Disposal Area DA303, located at the end of Lee Street, Town of Ocean Isle Beach, NC, prior to maintenance dredging of the "natural" canals. General scope of work includes excavation and offsite disposal of approximately 86,382 cubic yards of previously dredged unclassified material within the project area within USACE Disposal Area DA303, including clearing area prior to excavation, construction of new and repairing of existing dike walls, installation of a new effluent discharge structure and all related appurtenances. All Contractors are hereby notified that they must have proper license under North Carolina State laws governing their respective trades. Contractor's offsite disposal area shall be an approved state permitted high ground disposal area or mine for receipt of the excavated material. Copy of current permit shall be attached to bid. Each proposal shall be accompanied by a cash deposit or a certified check drawn on a bank or trust company insured by the Federal Deposit Insurance Corporation of an amount equal to not less than five (5%) percent of the proposal. In lieu thereof, a Bidder may file a bid bond executed by a corporate surety licensed under the laws of North Carolina to execute such bonds, said deposit checks or bond to be retained by the Owner as liquidated damages, in event of failure of the successful bidder to execute the contract within the ten (10) days after the award or to give satisfactory surety as required by law, Public Laws 133, Section 1, Chapter 400, General Statutes of North Carolina 1943, C 143, Article 8, 129, amended by Public Law ratified April 14, 1951. Performance and Payment Bonds are required for one hundred (100%) percent of the contract price. Payment will be made on the basis of ninety-five percent (95%) of monthly estimates up to 50% of Work completed and one hundred percent (100%) of monthly estimates for remaining Work. Final payment will be made upon completion and acceptance of the work. No bids may be withdrawn after the scheduled closing time for the receipt of bids for a period of sixty (60) days. The Owner reserves the right to reject any or all bids and to waive informalities.
