The sealed proposal of each bidder shall be accompanied by a Noncollusion Affidavit, Business Relationship Affidavit, Experience and Equipment Questionnaire and a Certified or Cashier's Check or Bidder's Surety Bond in the sum of five percent (5%) of the amount of the bid will be required from each bidder to be retained as liquidated damages in the event the successful bidder fails, neglects, or refuses to enter into said contract for the construction of said public improvements for said project, and furnish the necessary bonds within ten (10) days from and after the date the award is made. A Performance Payment Bond in an amount equal to one hundred percent (100%) of the approximate total amount of the Contract, guaranteeing the full and faithful execution of The Work and performance of the Contract and for the protection of the Owner and all property owners interested against any damage by reason of negligence of the Contractor, or the improper execution of The Work or the use of inferior materials. A good and sufficient Statutory Bond in an amount equal to one hundred percent (100%) of the approximate total amount of the Contract, guaranteeing payment for all labor, materials and equipment used in the construction of the improvements. A good and sufficient Maintenance Bond in an amount equal to one hundred (100%) of the total amount of the Contract, guaranteeing the maintenance in good condition of such improvements for a period of one (1) year from and after the time of the completion and acceptance by the Owner of said improvements. Each bid must be accompanied by cash, certified check of the Bidder or a bid bond duly executed by the Bidder as principal and having as surety thereon a surety company approved by the Owner, in the amount of five percent (5%) of the bid.
