Any contract or contracts awarded under this Request for Proposals (RFP) are expected to be funded in part by financial assistance from the TWDB. Neither the U.S. Environmental Protection Agency (EPA) or the State of Texas, nor any of its departments, agencies, or employees, are or will be a party to this RFP or any resulting contract. Any contract(s) awarded under this RFP is/are subject to the American Iron and Steel (AIS) requirements of federal law, including federal appropriation acts and Section 1452(a)(4) of the Safe Drinking Water Act (42 U.S.C. 300j-12(a)(4)), as applicable. Crystal Clear Special Utility District expressly reserves the right to reject any or all Proposals and to waive minor irregularities or informalities. The project will be awarded to the highest scoring respondent based on set evaluation criteria. A Respondent's failure to respond to the requested qualifications inquiry may result in the proposal being deemed non-responsive. Proposals may be held by Crystal Clear Special Utility District for a period not to exceed 60 days from the date of opening for the purpose of reviewing the proposals and evaluating respondent's qualifications prior to the contract award. This contract is subject to the Environmental Protection Agency's (EPA) Disadvantaged Business Enterprise (DBE) Program, which includes EPA-approved fair share goals toward procurement of Minority and Women-owned business Enterprise (M/WBE) business. EPA rules require that applicants and prime contractors make a good faith effort toward a fair share of contracts, subcontracts, and procurements to M/WBEs through demonstration of the six affirmative steps.
