The unit prices in the Contractor's Proposal are to include labor and equipment only. All non-consumable materials will be provided by Owner herein after "Owner Furnished Materials." (956) 983-6375 or Diane Solitaire (956) 983-6366 The Time for Completion of Construction of the project is of the essence of the Contract and shall be as specified in each Section Notice to Proceed. Each bid must be accompanied by a certified or cashier's check, or a bid bond prepared on the form of the bid bond attached hereto, duly executed by the BIDDER as principal and having as surety therein a surety company approved by the Owner, and authorized to do business in the State of Texas, in the amount of not less than five (5%) percent. Payment and Performance Bond. The contractor shall provide payment and performance bonds, based on the amount or estimated amount of any future Section. Bidder will be required to comply with all federal, state, and local laws, rules, and regulations applicable to its performance, including those pertaining to the licensing of contractors, and the Anti Kick-Back Act of 1986 Contract is Entire Agreement. The Contract to be effected by the acceptance of the Proposal shall be deemed to include the entire agreement between the parties thereto, and the Bidder shall not claim any modifications thereof resulting from any representation or promise made at any time by any officer, agent or employee of the Owner or by any other person. The initial term of this contract will be for two (2) years from the date of award. Brownsville PUB may, unilaterally, extend the contract with the option to renew for three (3) additional one (1) year periods if price and services are satisfactory and agreed upon in writing by both parties. The Owner reserves the right to waive minor irregularities or minor errors in any Proposal, if it appears to the Owner that such irregularities or errors were made through inadvertence. Any such irregularities or errors so waived must be corrected on the Proposal in which they occur prior to the acceptance thereof by the Owner. Bid Rejection. The Owner reserves the right to reject any or all Proposals
