Site work, paving and outdoor lighting for a transportation facility in Fort Smith, Arkansas. Completed plans call for site work for a transportation facility; for outdoor lighting for a transportation facility; and for paving for a transportation facility.

The Project Is Planned to Be Constructed During the Summer and Fall Months in 2021 and Generally Consists of the Rehabilitation of Runway 7/25 Per Faa Specifications, Including, but Not Limited to, Demolition and Pavement Restoration of Two (2) in-pavement Aircraft Arresting Systems, Pavement Milling, Asphalt Joint/crack Sealing, Asphalt Deep Patching, Paving Fabric, Asphalt Overlay, Pavement Grooving, Pavement Markings, Runway/taxiway Lighting and Sign Modifications, Among Other Related Items of Work. proposal guaranty in the form of a bid bond executed by a reliable Surety Company, or a certified or cashier's check drawn on a National Bank or a bank having membership in the Federal Reserve System. The proposal guaranty shall be in an amount not less than five percent (5.0%) of the total amount bid made payable without recourse to the Fort Smith Airport Commission as a guarantee that the Bidder will enter into a contract, including execution of payment and performance bonds, within ten (10) days after notice of award of a contract by the Owner. Required contract provisions required for FAA AIP construction projects are included in the contract documents and include the following provisions, among others: Affirmative Action Requirements, Buy-American Preference, Civil Rights - Title VI Assurances, Davis-Bacon Labor Provisions, Debarment and Suspension, Disadvantaged Business Enterprise, Foreign Trade Restriction, Lobbying Federal Employees, and Procurement of Recovered Materials. The Fort Smith Airport Commission, in accordance with the provisions of Title VI of the Civil Rights Act of 1964 (78 Stat. 252, 42 and the Regulations, hereby notifies all bidders or offerors that it will affirmatively ensure that any contract entered into pursuant to this advertisement, disadvantaged business enterprises will be afforded full and fair opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, or national origin in consideration for an award. All bidders shall make a good faith effort, as defined by Appendix A of 49 CFR Part 26, Regulations of the Office of the Secretary of Transportation, to subcontract a minimum of 9.1% of the dollar value of the prime contract with small businesses owned and controlled by socially and economically disadvantaged individuals (DBE). The Bidder's attention is called to the "Equal Opportunity Clause" and the "Standard Federal Equal Employment Opportunity Construction Contract Specifications" set forth Required Contract Provisions. The goals and timetables for minority and female participation, expressed in percentage terms for the contractor's aggregate workforce in each trade on all construction work in the covered area, are as follows: Goals for minority participation for each trade:5.6% Goals for female participation in each trade:6.9% These goals are applicable to all of the Contractor's construction work (whether or not it is Federal or federally assisted) performed in the covered area. If the Contractor performs construction work in a geographical area located outside of the covered area, it shall apply the goals established for such geographical area where the work is actually performed. With regard to this second area, the Contractor also is subject to the goals for both its federally involved and non-federally involved construction. The Contractor's compliance with the Executive Order and the regulations in 41 CFR Part 60-4 shall be based on its implementation of the Equal Opportunity Clause, specific affirmative action obligations required by the specifications set forth in 41 CFR 60-4.3(a) and its efforts to meet the goals. The hours of minority and female employment and training must be substantially uniform throughout the length of the contract, and in each trade, and the Contractor shall make a good faith effort to employ minorities and women evenly on each of its projects. The transfer of minority or female employees or trainees from Contractor to Contractor or from project to project for the sole purpose of meeting the Contractor's goals shall be a violation of the contract, the Executive Order and the regulations in 41 CFR Part 60-4. Compliance with the goals will be measured against the total work hours performed. The Contractor shall provide written notification to the Director of the Office of Federal Contract Compliance Programs (OFCCP) within 10 working days of award of any construction subcontract in excess of $10,000 at any tier for construction work under the contract resulting from this solicitation. The notification shall list the name, address, and telephone number of the subcontractor; employer identification number of the subcontractor; estimated dollar amount of the subcontract; estimated starting and completion dates of the subcontract; and the geographical area in which the subcontract is to be performed. As used in this notice and in the contract resulting from this solicitation, the "covered area" is Arkansas, Sebastian County, City of Fort Smith. a copy of which is included in the contract documents. All laborers and mechanics employed by contractors and subcontractors on projects funded directly by or assisted in whole or in part by and through the Federal Government shall be paid wages at rates not less that those prevailing on projects of a character similar in the locality as determined by the Secretary of labor in accordance with the subchapter IV of Chapter 31 of Title 40, United States Code. Act 150 of 1965, as amended, Arkansas Statutes, states that a Contractor must be licensed by the State Licensing Board of Contractors, or have an application for license on file with the Licensing Board, before he/she may submit a bid for work when the cost thereof is Fifty Thousand Dollars ($50,000.00) or more. No Proposal may be withdrawn within ninety (90) calendar days after the date of opening of Proposals. The awarding of this contract work is contingent upon the Fort Smith Airport Commission's receipt of sufficient funding from the Federal Aviation Administration. The Fort Smith Airport Commission reserves the right to reject any or all bids, to waive technicalities/irregularities in the bids, except for those affecting Equal Employment Opportunity matters. The successful bidder must furnish a payment and performance bond upon the form provided in an amount equal to one-hundred percent (100%) of the total contract price from an approved surety company licensed in the State of Arkansas to act as a surety, or other surety acceptable to the Owner.
