**As of May 14, 2021. the project has not yet awarded, no time frame provided at this time. The project consists of the Town Hall ADA Improvements in the Town of Montgomery. Information for Bidders, Specifications, and Contract Documents for the proposed work are on file and publicly exhibited at the Town of Montgomery Town Hall, 110 Bracken Road, Montgomery, New York, 12549, Telephone Number (845) 457-2640. The bid documents may also be obtained electronically by submitting a deposit with the Town Clerk and requesting that the documents be e-mailed or a thumb drive mailed to the requestor. The deposit shall be in the form of check or money order only - NO CASH and shall be made payable to the Town of Montgomery, deposits may be refunded in accordance with Section 102 of General Municipal Law. The Addenda, if any will be issued only to those persons whose name and address are on the record as having obtained the contract documents. Each bid shall be accompanied by an acceptable form of Bid Guarantee in an amount equal to at least five (5) percent of the amount of the Bid payable to the Town of Montgomery as a guarantee that if the Bid is accepted, the Bidder will execute the Contract and file acceptable Performance and Labor, Material Payment Bonds, and Certificate (s) of Insurance within ten (10) days after the award of the Contract. All bidders are required to familiarize themselves with the existing conditions and proposed improvements prior to submitting the sealed proposal in accordance with this Advertisement for Bids. OWNERS RIGHTS RESERVED: The Town of Montgomery, hereinafter called the Owner, reserves the right to reject any and all Bids and to waive any formality or technicality in any bid in the interest of the Owner. STATEMENT OF NON-COLLUSION: Bidders on the Contracts are required to execute a non-collusion bidding certificate pursuant to Section 103d of the General Municipal Law of the State of New York. Prevailing wages established under the Davis Bacon Act will apply to this contract. The contract documents contain requirements addressing prevailing labor wage rates, labor standards, nondiscrimination in hiring practices, goals for minority and female participate and related matters. Attention of bidders is particularly called to the requirement as to conditions of employment to be observed and minimum wage rates to be paid under the contract, Section 3, Segregated Facilities, Section 109, and Executive Order 11246. The requirements for Bidders and Contractors under this order, which concerns non-discrimination in employment, are explained in the Contract Documents. Bidders are also required to comply with the provisions of Section 291-299 of the Executive Law of the State of New York. The Town of Montgomery hereby notifies all Bidders that it will affirmatively insure that in regard to any Contract entered into pursuant to this advertisement, minority business enterprises will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, or national origin in consideration for an award.
