The successful bidder must comply with the Davis-Bacon Act which requires that all laborers and mechanics shall be paid at rates not less than those determined by the Department of Labor to be the prevailing for the locality in which the project is located. This project is being funded in part by the Appalachian Regional Commission (ARC) Grant #MS-19611 and the rules and regulations therein apply. The contract will be awarded as an entire job and individual items will not be let for separate work. Each bidder must deposit with this bid, security in the amount, form and subject to the conditions provided in the Information for Bidders. No Bidder may withdraw his bid within 90 days after the actual date of the opening thereof. Simultaneously with his delivery of the executed contract, the Contractor shall furnish surety bonds subject to the conditions provided in the Information for Bidders. All applicable laws, ordinances and the rules and regulations of all authorities having jurisdiction over construction of the project shall apply to the contract throughout. Each Bidder is responsible for inspecting the site and for reading and being thoroughly familiar with the Contract Documents. The failure or omission of any Bidder to do any of the foregoing shall in no way relieve any Bidder from any obligation in respect to this Bid. A conditional or qualified Bid will not be accepted. Award will be made to the lowest responsible, responsive Bidder. The Owner reserves the right to waive any informality or to reject any or all Bids.
