Site work and paving for a mixed-use development in Siloam Springs, Arkansas. Completed plans call for site work for a bridge / tunnel; for paving for a bridge / tunnel; road / highway; road / highway; sidewalk / parking lot; sidewalk / parking lot; and water / sewer project.
The scope of work includes construction of approximately 1,400 linear feet of a ten foot wide sidepath, including drainage improvements and the purchase and installation of a premanufactured pedestrian bridge. A State of Arkansas Contractor's License is not required to bid on the project; however, no contractor shall submit a bid prior to submitting an initial application (which does not require a full audit) for licensure, and no construction contract shall be executed until the successful bidder has finished an appropriate license issued by the State of Arkansas Contractor's Licensing Board. The City shall open and compare the bids and thereafter award the contract to the lowest responsible bidder, but only if it is in the opinion of the City that the best interests of the City would be served thereby. The City reserves the right to reject any or all bids, to waive irregularities, and to postpone the award of the Contract for a period of time which shall not exceed 90 days from the bid opening date. "Buy America" provisions apply to this project. The Arkansas Department of Transportation's Standard Specifications Section 106 has requirements and restrictions for Buy America. Also, 23 CFR 635.410 has all of the federal requirements for Buy America. The Contractor shall commence Work under this Agreement on a date to be specified in a written Notice to Proceed and shall fully complete all the Work hereunder in one hundred twenty (120) calendar days. The Contractor and the City recognize that time is of the essence in the progress of this project and that the City will suffer financial loss if the Work is not fully completed within the time specified herein. Therefore, the Contractor and the City agree that liquidated damages in the amount of Two Hundred Fifty Dollars ($250) a day will be assessed by the City against the Contractor for each day after the time specified herein that the Work is not fully completed.
