ADDITIONAL REQUIREMENTS: During the performance of this contract the Contractor agrees to comply with the requirements of P.L. 1975, c. 127 (N.J.A.C. 17:27), all require-ments of the State of New Jersey Worker Health and Safety Act (N.J.A.C. 12:110 et seq.) as amended and the United States Occupational Safety and Health Act (OSHA) (29 CFR 1910), as amended with regard to worker and jobsite safety. 16. OWNER'S RIGHTS: The Township reserves the right to increase or decrease quantities specified in the manner designated in the Specifications. The Township reserves the right to award this contract based on funds available. 17. BID WITHDRAWAL: The Bidder shall comply with the statutory requirements set forth in N.J.S.A. 40A:11-23.3 regarding bid withdrawal. The successful bidder will be required to furnish a surety company bond in the full amount of the contract price indemnifying the Township of Brick, New Jersey for all proceed-ings, suits or actions of any kind of description and conditional for the faithful perform-ance of the work. 18. REJECTION OF BIDS: Owner reserves the right to reject all Bids and to waive any immaterial defect or informality in any Bid, if deemed in the best interest of the Owner.
