Request for Proposals Construction Services for District Improvements Lee County, Florida Brightwater Community Development District (the "District") hereby requests proposals to provide services relating to the following: Brightwater, Phase 2, North Ft. Myers, Florida lake excavation, embankment, stormwater, roadways, potable water and sanitary sewer systems. Each Bid Package will include, but not be limited to, the Request for Proposals, proposal and contract documents, and construction plans and specifications. Please make checks payable to Banks Engineering. Mr. Samuel Marshall, P.E. shall be the contact person with regard to the Bid Packages. The District has the right to reject any and all proposals, make modifications to the work, and waive any minor informalities and irregularities in proposals as it deems appropriate, if it determines in its discretion that it is in the best interest of the District to do so. In Addition, this project is subject to the availability of funds and the project may be cancelled if funds are not available. The successful proposer must execute a contract with the District and file the requisite Performance and Payment Bonds and insurance within fourteen (14) calendar days after the receipt of the Notice of Award. Any person who wishes to protest the Bid Package, or any component thereof, shall file with the District a written notice of protest within seventy-two (72) hours after the Bid Package is made available, and shall file a formal written protest with the District within seven (7) calendar days after the date of timely filing the initial notice of protest. Filing will be perfected and deemed to have occurred upon receipt by the District Manager, Development Planning & Financing Group, Inc., 15310 Amberly Drive, Suite 175, Tampa, Florida 33647. Failure to timely file a notice of protest or failure to timely file a formal written protest shall constitute a waiver of any right to object to or protest the contents of the District's Bid Package. The formal written protest shall state with particularity the facts and law upon which the protest is based. Any and all questions relative to this project shall be directed in writing only to Banks Engineering, 10511 Six Mile Cypress Parkway, Suite #101, Ft. Myers, FL 33966 or via e-mail to SMarshall@BanksEng.com no later than 2:00 p.m. Thursday, July 8th, 2021. Proposals shall be submitted in a sealed opaque package, shall bear the name of the proposer on the outside of the package and shall identify the name of the project. Proposals will be opened at the time and date stipulated above; those received after the time and date stipulated above will be returned un-opened to the proposer. Any proposal not completed as specified or missing the required proposal documents as provided in the Bid Package may be disqualified.
