Bids shall be based upon cash payment for the following general items: The project shall consist of Approximately 1,053 LF of concrete Cart path. Bids will be received as a Unit Price bid for General Construction. The Owner intends to award the Bid on the basis of the low bid submitted by a responsible and responsive bidder for the aggregate sum of all bid items. The Owner reserves the right to reject any and all Bids, and to accept the bid deemed most favorable to the interest of the Owner. Each Bid shall be accompanied by a separate envelope containing a Bidder's Bond in a sum equal to five percent of the full amount of the Bid, executed by the Bidder as principal and by a surety company authorized to do business in this state, conditioned that if the principal's Bid is accepted and the contract awarded to the principal, the principal, within ten days after Notice of Award, shall execute and effect a contract in accordance with the terms of his Bid and a Contractor's Bond as required by law and the regulations and determinations of the governing body. The Bid Bond of the three lowest Bidders will be retained until the contract has been awarded and executed, but not longer than sixty (60) days. The Bid security is a guarantee that the Bidder will enter into contract for the work described in the Proposal. The bidder may submit a Bid Bond, certified check, or cashier's check payable to the Bismarck Parks and Recreation District. All Bidders shall have a valid North Dakota Contractor's license of the appropriate Class for the work. Bidders shall enclose a copy of the license or Certificate of Renewal in the same envelope as the Bidder's Bond. Failure to do so will render the Bid invalid. No Bid will be read or considered unless it fully complies with the Bond and license requirements. Any deficient Bid will be resealed and returned to the Bidder immediately. The successful Bidder shall be required to furnish both a Performance Bond and Payment Bond in the full amount of the Contract. Upon commencing the Work on site, the Contractor shall achieve Substantial Completion within 21 calendar days. The Work under this Contract shall be Substantially Completed by September 15, 2021 and shall achieve Final Completion by October 15, 2021.
