(4) All required Asbestos Removal has been completed. Copies of the reports will be supplied to the successful bidder. The successful bidder agrees to hold harmless the State of Tennessee and the Tennessee Department of Transportation from any and all claims, sanctions, fines and penalties of any kind from whatever source. The buildings are to be removed to ground level and all debris removed from this tract. All concrete slabs must be broken up and removed from the tract unless otherwise approved by the Tennessee Department of Transportation. It is understood that failure to comply with the terms and conditions stated herein will constitute a waiver of any right to any payment for any work done on this removal; and a waiver of any right to any part or materials of or from the buildings or other improvements included in this offer.
