Site work and paving for a civil project in Franklin, Massachusetts. Completed plans call for site work for a road / highway; for paving for a road / highway; and water / sewer project.

Installation of 1,300 LF of eight-inch and six-inch sewer main and services, 160 feet of eight-inch water main, abandonment and removal of asbestos cement mains, trench paving and all other work specified in the contract drawings. The Contractor shall perform all Work required by the Contract Documents for Sewer Main Replacement prepared by the GCG Associates, Inc. acting as and referred to in the Contract Documents as the "Prime Designer". This section Supplements the General Conditions and other sections of Division 1 and supersedes any provisions regarding material substitutions/Or equals found in any of the technical sections of the specifications. The requirements of this section are in addition to any provisions of all other sections of these specifications. Definition-Whenever a specification section names one or more brands for a given item, and the Contractor wishes to submit, for consideration, another brand, the submission shall be considered an "or-equal" or a "material substitution". For the purposes of this Contract, the terms "or-equal" and "material substitution" shall be considered synonymous. In no case may an item be furnished on the Work other than the item named or described, unless the Architect, with the Administrator's written concurrence, shall consider the item equal to the Item so named or described, as provided by M.G.L. c.30 39M. The equality of items offered as "equal" to items named or described shall be proved to the satisfaction of the Architect at the expense of the Contractor submitting the substitution. The Architect and/or the Department may require that full size samples of both the specified and proposed products be submitted for review and evaluation. The Contractor shall bear full cost for providing, delivering, and disposal of all such samples. The Contractor shall assume full responsibility for the performance of any item submitted as an "Or- Equal" and assume the costs of any changes in any Work that may be caused by such substitution.
