The work consists of furnishing all labor, materials, tools, equipment and incidentals necessary for the complete installation of the Villa Park Knowles Upgrade Project, as indicated in the Landscape Plans.to be constructed hereunder is located in the City of Villa Park, and as shown on the construction plans. Site improvements such as new decomposed granite walkways, planting, irrigation and site amenities shall be installed to enhance the open space greenbelt located along the east side of Wanda Road between Villa Park Road and Lincoln Street as well as the corner monument located on the north east corner of Wanda Road and Collins Avenue. This is a State Project part of the 2018 Parks Bond Act with Project Numbers 18-30-023 and 18- 30-024. The Agency reserves the right, after opening bids, to reject any or all bids, or to make award to the lowest responsible bidder and reject all other bids; to waive any informality in the bidding; and to accept any bid or portion thereof; and to take all bids under advisement for a period of fortyfive (45) days. Bids will be compared on the basis of the architect's estimate of the quantities of the several items of work as shown on the plans. Only such plans, specifications, and items of work as are appropriate shall apply to the work as bid. At the time of contract award, the contractor shall possess a Class "A" (General Contractor) and/or Class "27" (Landscaping) Contractor's License. Each bid must be accompanied by a certified or cashier's check, or by a corporate surety bond on the form furnished by the AGENCY, as a guarantee that the bidder will, if an award is made to him in accordance with the terms of his bid, promptly secure workmen's compensation insurance and liability insurance, execute a contract in the required form, and furnish satisfactory bonds for the faithful performance of the contract and for the payment of claims of material and laborers thereunder. Said check or bidder's bond shall be in an amount not less than 10 percent of the amount of the bid. The Performance Bond shall be not less than 100 percent of the total amount of the bid price named in the contract. The Payment Bond shall be not less than 100 percent of the total amount of the bid price named in the contract. The AGENCY reserves the right to reject any bond if, in the opinion of the AGENCY Attorney, the Surety's acknowledgment is not in the form included in the contract documents or in another form substantially as prescribed by law. Any Contract entered into pursuant to this notice will incorporate the provisions of the State Labor Code. Compliance with the prevailing rates of wages and apprenticeship employment standards established by the State Director of Industrial Relations will be required. Affirmative action to ensure against discrimination in employment practices on the basis of race, color, national origin, ancestry, sex or religion will also be required. The AGENCY hereby affirmatively ensures that minority business enterprises will be afforded full opportunity to submit bids in response to this notice and will not be discriminated against on the basis of race, color, national origin, ancestry, sex or religion in any consideration leading to the award of contract. The Contract Documents call for monthly progress payments based upon the Project Manager's estimate of the percentage of work completed. The AGENCY will retain 5 percent of each progress payment as security for completion of the balance of the work. At the request and expense of the successful bidder, the City will pay the amounts so retained upon compliance with the requirements of Government Code Section 4590 and the provisions of the Contract Documents pertaining to Substitution of Securities. The time within which the Work must be completed by the Contractor, including the delivery of all materials, testing and acceptance by the Agency is fixed at Sixty (60) working days, starting from and after the date in the Notice to Proceed with the Work, exclusive of maintenance periods.
