The Township will award a contract based upon the bid submitted by the lowest responsible bidder. Bid Proposals must be accompanied by a certified check, cashiers check, or bid bond made payable without condition to the Township of Fredon in an amount not less than 10% of the amount of the bid, but not to exceed $20,000 in accordance with N.J.S.A. 40A:11-21. The Township will not be responsible for late mail deliveries and no bids will be accepted after the time stipulated in the NOTICE TO BIDDERS. Prospective bidders are hereby notified that the Township intends to conduct a referendum permitting it to increase the allowable 2022 tax levy and final appropriation sufficient to make an award. The levy cap question will be placed on the ballot for the 2022 school board election scheduled for April 19, 2022. To satisfy general referendum procedures, the Township requests that the time for making an award be extended from 60 days to 112 days after bid opening. By submitting a Bid Proposal, the Bidder acknowledges the Township's request, and expressly consents to extending the award period as requested. No Bidder may withdraw its bid during this time. Any award is subject to the above referendum and the discretion of the Township of Fredon. Bidders are required to comply with the requirements of N.J.S.A. 10:5-31 et. seq. and N.J.A.C. 17:27-1 et. seq. regarding Affirmative Action and Mandatory Equal Employment. The Township Committee reserves the right to award a contract in its sole discretion and further reserves the right to reject any and all bids, waive irregularities, and decide as to the responsibility of the bidders, and make an award on a lump sum basis.
