Bidders shall promptly notify krevalli@didonato.cc of any errors, omissions, conflicts or ambiguity within the Contract Documents within 7 days of bid opening. If bidders wish to purchase printed copies of the Contract Documents (beyond the Proposal), they may be obtained through Avalon. Only official planholders will be allowed to obtain printed copies of the Contract Documents. Bidders acknowledge that they are responsible for review of all components of the Contract Documents, including all specification sections and drawings, regardless of how many drawings they print and in which format/size they are printed. Full-size drawings are on 22" x 34" paper. Bidders acknowledge they are responsible for properly scaling drawings if they are printed at any other size. Bids must be submitted upon the proposal form(s) furnished in the Proposal, and must not be detached from the Proposal. A bid security in the amount of 5% of the total bid payable to "Village of Hamburg" will be required and is subject to the conditions provided in the Instructions to Bidders. Failure to submit a bid bond or certified check with bid will result in automatic disqualification of bid. If, upon acceptance of his bid, a Bidder fails to enter into a Contract with the Village of Hamburg, the bid security shall be forfeited to and become the property of the Village. Failure to submit a bid on the proposal form(s) furnished in the Proposal, or submittal of form(s) detached from the Proposal will result in automatic disqualification of bid. Addendum pages, if issued, shall be stapled to the original pages of the Proposal and submitted as part of the Bid. No bidder may withdraw his bid within forty-five (45) days after the date of the bid opening. The successful bidder must furnish a 100% Performance and Payment Bond with a surety company satisfactory to the Village of Hamburg and conforming to the prerequisite requirements of Article 5 of the General Conditions. The successful Bidder and all subcontractors must have an approved CCA-2 on file with NYSDOT prior to being awarded a contract. If the successful Bidder does not currently have a CCA-2 on file with NYSDOT, the Bidder may find the CCA-2 forms and instruction for completion online at https://osc.state.ny.us/venrep/form_cca2.htm. The work will be substantially completed 120 working days from Notice to Proceed. The Village of Hamburg is exempt from the payment of sales and compensating use taxes of the State of New York and of cities and counties on all materials, equipment, and supplies sold to the Village of Hamburg pursuant to this Contract. Also exempt from such taxes are purchases by the Contractor and his Subcontractors of materials, equipment, and supplies to be sold to the Village of Hamburg pursuant to this Contract, including tangible personal property to be incorporated in any structure, building, or other real property forming part of the Project. These taxes are not to be included in the Bid. The Village of Hamburg reserves the right to waive any informalities or to reject any or all bids. Bidders are required to certify, under penalty of perjury, that bids have been prepared without collusion with other bidders, subcontractors, suppliers, etc. This certification is included with the Bid Proposal, which each Bidder must sign in the space provided. All bids must include the completed Non-Collusive Bidding and Disbarment Certifications, and Lobbying Certifications.
