The Work to be completed under this contract includes the mill and overlay of roadway surfaces at specified locations in Warminster Township, including base repair, leveling course and pavement markings. The quantities and road list are provided in Section 01 22 00 Measurement and Payment. All material, labor, and equipment necessary shall be in accordance with portal Publication 408 and Township Standards with the exception of the provisions of PennDOT Publication 408, Section 110.04, Price Adjustments of Asphalt Materials. No price adjustments will be made to the contract based on the fluctuation of Asphalt Cement and Diesel Fuel Price Indexes. The Township intends for work to begin no earlier than May 1, 2022 and to be substantially completed within 45 calendar days after the contract times commence. A nominal fee of 0.33% of the bid amount (from $100 up to $5,000) is assessed only to bidders awarded contracts. This project is subject to applicable provisions of Act 89, Transportation (74 PA.C.S.) and Vehicle Code (75 PA.C.S.) Omnibus Amendments and applicable provisions of Act 422, Pennsylvania Prevailing Wage Act, as amended, and the prevailing minimum wage rates issued by the Pennsylvania Department of Labor and Industry for work valued at over One Hundred Thousand Dollars ($100,000). If the Contract Price exceeds $350,000.00, the project is subject to the Township's Responsible Contractor Requirements. All bids shall remain subject to acceptance for 60 days after the Bid Opening or for such period of time that Bidder may agree to in writing upon request. Bids may be withdrawn within two (2) business days after the opening of Bids only by the withdrawing Bidder's strict compliance with 73 P.S. 1602 and any subsequent amendments. Warminster Township reserves the right to reject any and all bids for any cause whatsoever, to eliminate any item or items from the contract, and to waive any informality in the bids.
