1 The Contractor shall be responsible to supply all labour, material and equipment to provide litter clean up, and lawn cutting (during the cutting season) and specified in this section for all green spaces; walkways; parking areas; building exits and for the properties listed in this tender. The Contractor shall indemnify and save harmless the Authority from and against all claims, losses, costs, damages, suits, proceedings, or actions arising out of or related to the Contractor's activities in executing the work, including omissions, or improper acts in executing the work. The Contractor shall pay for and maintain liability insurance in an amount of not less than One Million Dollars ($1,000,000) in respect to any one accident or occurrence against claims for personal injury, death, or property damage or loss arising from any act, fault or omission of the Contractor. Certificates of Insurance showing the or loss arising from any act, fault or omission of the Contractor. Certificates of Insurance showing the Minister/Nova Scotia Department of Municipal Affairs and Housing and the Western Regional Housing Authority as a named insured shall be filed with the Authority before work commences. Date(s) Products/Service Delivery Expected: Anticipated start date April 20, 2022 to April 30, 2022 with an anticipated end date of November 15, 2022 The Contractor shall carry Workers Compensation coverage on all employees engaged under this Contract. The Contractor shall supply the Authority with a Letter of Good Standing from the Workers Compensation Board and their Revenue Canada Business Number prior to commencing any work. The parties acknowledge that the obligations of each party from time to time to meet certain terms and conditions of this Tender may be impeded by the COVID-19 pandemic (the "Pandemic") and related challenges. The Contractor and the Province agree to act in good faith by making all reasonable accommodations as the circumstances of the Pandemic may require, and each party agrees to exercise reasonable efforts to comply with the terms of this Tender notwithstanding the effects of the Pandemic. No party will require or encourage any person acting on its behalf to violate the terms of any order made pursuant to the Health Protection Act (Nova Scotia), the Emergency Management Act (Nova Scotia) or any other order or directive made pursuant to applicable provincial or Federal legislation in relation to the Pandemic ("Pandemic Orders"), or to perform any act which would place such person at a material risk of contracting the COVID-19 virus. The Province and Contractor acknowledge that any costs associated with compliance with any Pandemic Order for the duration of this agreement shall be included in the bid response.
