Each Bid must contain the full name or names of the party or parties making the same, with an affidavit as to interested parties and in the case of a corporation not chartered in Ohio, with a proper certificate that such corporation is authorized to do business in Ohio. Each bidder is required to furnish with its Proposal a Bid Guaranty and Contract Bond in accordance with Section 153.54 of the Ohio Revised Code or a certified check or cashier's check equal to ten percent (10%) of the amount bid, payable to the City of Macedonia. The Bid security in Bond form shall be issued by a Surety Company or Corporation licensed in the State of Ohio to provide said surety. The Bid Guaranty will be held, if the Bid Proposal is accepted, to guarantee a Contract will be entered into in accordance with ORC 153.54. The price of material and labor bid for shall be separately stated. All contractors and subcontractors involved with the project will, to the extent practicable, use Ohio Products, materials, services, and labor in the implementation of their project. Additionally, contractor compliance with the equal employment opportunity requirements of Ohio Administrative Code Chapter 123, The Governor's Executive Order of 1972, and Governor's Executive Order 84-9 shall be required. Bid Guaranty and Contract Bond or check, as the case may be, will be held as a guarantee that, if the Bid Proposal is accepted, a Contract will be entered into between the bidder and the City of Macedonia, and the performance of such Contract secured by said check or bond. In default thereof said bond or check, and the amount represented thereby, shall be forfeited to the City of Macedonia as liquidated damages. Council of the City of Macedonia reserves the right to reject any and all bids, to waive any informalities in the bids received, and to accept any bid which it deems most favorable to the City. The Contractor shall perform everything required to be performed and shall provide and furnish all of the labor, materials, necessary tools, expendable equipment, and all utility and transportation services required to perform and complete in a workmanlike manner all the work required for the: HIGHLAND ROAD PHASE II RESURFACING IN THE CITY OF MACEDONIA, COUNTY OF SUMMIT, STATE OF OHIO all in accordance with the Plans and Specifications reviewed and/or prepared by Joseph L. Gigliotti, Engineer and in these Contract Documents referred to as the Engineer which Plans and Specifications are made a part of this Contract, and in compliance with the Contractor's Proposal and the other Contract Documents herein mentioned which are a part of this Contract; and the Contractor shall do everything required by the Contract and the other Documents constituting a part hereof.
