Proposal Security: Each proposal shall be accompanied by a certified or cashier s check or proposal bond acceptable to the Owner in an amount at least equal to five percent (5%) of the total amount of the proposal and payable without conditions to the Owner. The proposal security which must accompany each proposal is required as a guarantee that the Contractor will enter into contract with the Owner for the work described in the proposal and furnish performance bond as specified. Liquidated Damages: Liquidated damage will be assessed to the Contractor for damages which the Owner will suffer by reason of the fact that the Contractor does not complete work which such Contractor is required to perform within the time specified and in the contract, by reason of increased cost of inspection, loss to the Owner by not having use of the building or any other expense incurred by the failure to complete the job within the time specified. The Contractor agrees that to the extent possible, the Owner may deduct from the amount otherwise due the Contractor $1,000 per day, for each calendar days of delay in completion of the work on each scheduled completion date as stated above and agrees that to the extent it is not possible to make such deductions from the amount otherwise due the Contractor, the Contractor will pay the Owner $1,000 for each calendar day the work remains incomplete, and it is agreed that such deductions or payments will be taken as liquidated damages and not as a penalty. Performance and Payment Bonds: The successful proposals of the work will be required to furnish performance and payment bonds in an amount equal to one hundred percent (100%) of the contract price, giving as security an approved surety bond company bond, which shall meet a Class A rating by the BEST S INSURANCE RATING GUIDE. The performance bond shall cover both labor and materials. The work includes removal of old windows including glass, frames, and other items and the installation of new window frames, glass, and other items.
