Performance Bond and Material and Labor Payment Bond in amount of 100% of contract price shall be furnished by successful bidder. The Board reserves the right to accept or reject any or all bids and waives any informality in the bidding. The bidder acknowledges the right of the Owner to reject any or all bids and to waive any informality or irregularity in any bid received. In addition, the bidder recognizes the right of the Owner to reject a bid if the bidder failed to furnish any bid security, or to submit the data required by the bidding documents, or if the bid is in any way incomplete or irregular. Construction Schedule: Construction Schedule may start immediately and must be substantially complete by August 15, 2025. If the Contractor refuses, neglects, or fails to complete the Work within the time stated in the Contract, then the Contractor and the Contractor's surety, if any, shall be liable for and shall pay the Owner, not as penalty but as liquidated damages, the sum of four hundred dollars ($400.00) for each calendar day that the Contractor is in default after the time stipulated in the Contract for completing the Work of each Phase until the Work is Substantially Complete. The Owner may withhold from payments due the Contractor, such amounts as may be assessed as liquidated damages. Upon Substantial and Final Completion of the Work, the Owner may adjust the Contract Sum by the amount of the assessed liquidated damages Furnish and install all Wrestling Mats, Wall Pads, Indoor Tennis Net, Retractable Batting Cages, Sunshade, Portable Soccer Goal, Free Standing Bleachers, and Field Layout & Plugs as shown on the drawings and specified herein.
