The Owner may waive any informalities or minor defects or reject any and all bids. Any bid may be withdrawn prior to the above scheduled time for the opening of bids or authorized postponement thereof. Any bid received after the time and date specified shall not be considered. No bidder may withdraw a bid within 60 days after the actual date of the opening thereof. Should there be reasons why the contract cannot be awarded within the specified period, the time may be extended by mutual agreement between the Owner and the Bidder. The quantities appearing in the bid schedule are approximate only and are prepared for the comparison of bid. Payment to the contractor will be made only for the actual quantities of work performed and accepted in accordance with the contract, except where final measurements are not made, as hereinafter provided. The scheduled quantities of work to be done and materials to be furnished may each be increased, decreased, or omitted as hereinafter provided. Each bidder shall specify in his proposal, in figures, a unit price for each, if itemized and a total price. The proposal shall not contain interlineations, alterations, or erasures. All entries on the proposal form shall be in ink. All errors in extensions or totals will be corrected by the Owner and such corrected extensions and totals will be used in comparing bids. A proposal of an individual, including those doing business under a fictitious name, shall be signed by the individual, and his address shown. The signature shall be exactly the same as that appearing on the Contractor's qualification form. A proposal by a partnership or joint adventure, including individuals doing business under fictitious names, or corporations, shall be executed by at least one of the partners followed by the title "Partner", or one of the joint adventurers followed by the title "Joint Adventure" and the business address of the partnership or joint adventure shown. The true legal name and address of each partner and joint adventurer shall also be shown and shall appear exactly the same as that shown on the Contractor's Qualification Form. A proposal by a corporation, whether acting alone or as a joint adventurer, shall show the address and name of the corporation exactly as shown on the Contractor's Qualifications Form and be signed by a person authorized by its Board of Directors to bind the corporation, with his title shown. All successful bidders who are corporations organized in states other than Missouri, shall furnish at their cost, a certified copy of a certificate of authority and license to do business in Missouri, said certificate to remain on file with the Owner. Such certified copy may be secured from the Corporation Supervisor in the office of Secretary of State, Capitol Building, Jefferson City, Missouri. No contract will be executed by the Owner until such certificate is furnished by the successful bidder. The successful bidder agrees to cause its authority and license to do business as a foreign corporation to be continued and extended throughout the life of the contract, and until all claims thereon and thereunder shall have been finally settled. No Bid Bond is required. Contractor shall be required to provide proof of $500,000 General Liability Insurance and Workmen's Compensation Insurance. A performance bond and a payment bond, each in the amount of 100 percent of the contract price, with a corporate surety approved by the Owner, will be required for the faithful performance of the contract. Bidder must agree to commence work on or before a date to be specified in a written "Notice to Proceed" of the owner and to fully complete the project within the number of consecutive calendar days thereto stated in the Proposal. Bidder must agree also to pay as liquidated damages, the sum noted in the bid document for each consecutive calendar day thereafter as hereinafter provided in the General Conditions. The owner may make such investigations as he deems necessary to determine the ability of the Bidder to perform the work, and the Bidder shall furnish to the owner all such information and data for this purpose as the owner may request. The owner reserves the right to reject any bid if the evidence submitted by, or investigation of, such bidder fails to satisfy the owner that such bidder is properly qualified to carry out the obligations of the Agreement and to complete the work contemplated therein.
