All bids to be considers shall be submitted on the Proposal Form contained in the Specifications and Contract Documents and shall be enclosed, at the time of submission, in sealed envelopes bearing the name and address of the bidder and the name of the project/service for which the bid is submitted on the outside of the envelope, and shall be addressed to "Mayor and Council, Borough of Lodi, Bergen County, New Jersey" Each envelope shall be labeled "Mechanical Repair Services and Material for the Borough of Lodi". As set forth in the Bid Specifications and Contract Documents, all bids submitted shall be accompanied by an Affidavit of Non-Collusion in the form contained in the Bid Specifications. In the event of the personal or hand delivery of a bid proposal, the Borough Clerk or her designee shall issue a written receipt acknowledging submission of the bid proposal upon the request of the bidder. Such receipt shall be deemed to constitute evidence of compliance with the Bid Specifications or any requirements of the Contract documents, but shall proof of the time of submission of the bid proposal only. In lieu of personal or hand delivery, bid proposals may be mailed to the Borough Clerk of the Borough of Lodi at the address set forth above, provided, however, that the mailing envelope shall therein contain a sealed envelope prominently identifying the bid proposal in the manner specified above. All such mailings shall be by Certified Mail, Return Receipt Requested. IN ORDER FOR ANY BID PROPOSAL TO BE CONSIDERED FOR AWARD, SUCH BID PROPOSAL MUST BE RECEIVED, WHETHER DELIVERED PERSONALLY OR BY MAIL, BY THE BOROUGH CLERK ON OR BEFORE THE DATE AND TIME SPECIFIED FOR THE RECEIPT OF BIDS AS SET FORTH ABOVE. The required Bid Proposal and Non-Collusion Affidavit forms are contained in the Bid Specifications and Contract Documents. Failure to utilize the required forms, and/or the failure to submit the required bid security as set forth above, shall result in the rejection of the bid proposal. Bidders are required to comply with the requirements and rules and regulations and orders promulgated by the State Treasurer pursuant to P.L. 1985, c. 127 et seq., as well as the provisions of N.J.S.A. 11:2-1 through N.J.S.A. 11:2- 4, and all other applicable statues, rules and regulations promulgated hereunder, the provisions of which are incorporated herein by reference. All bidders shall also comply with the requirements of P.L.1977, c.33 and all requirements of the Americans with Disabilities Act. THE BOROUGH OF LODI EXPRESSLY RESERVES THE RIGHT TO REJECT ANY OR ALL BIDS AND TOW AIVE ANY TECHNICAL ERRORS OR INFORMALITIES IN THE BID PROPOSALS OR IN THE DOCUMENTS ACCOMPANYING THE BID PROPOSAL IF SUCH REJCTION OR WAIYER IS IN THE BEST INTEREST AND WELFARE OF THE PUBLIC TO DO SO.
