This is a service / maintenance or supply contract in Appleton, Wisconsin. Contact the soliciting agency for additional information.

Work covered by this contract shall consist of cutting weeds, grass, brush, or other vegetation. This section requires that vegetation shall be cut to a height of eight (8) inches or less for developed lots and twelve (12) inches or less for undeveloped lots. Cuttings shall be collected and removed from the terrace and sidewalks and streets, where they exist. Where site conditions prohibit cutting with machinery, the work shall be done with portable equipment or other methods as conditions may dictate. In 2021, 46 work order were issue and in 2020, 24 work orders were issued that required the contractor to mow. Further, work covered by this contract will be performed by a Contractor who, having familiarized themself with the City's specifications for work or services to be performed, provides, and furnishes all labor, materials, necessary tools, expendable equipment, and all utility and transportation services necessary to perform in a complete and workmanlike manner required for the cutting of weeds, grass, brush, or other rank or offensive vegetation on private property within the City. If a significant ambiguity, discrepancy, omission, or other error is discovered, a supplement or modification will be provided to all original recipients of this document. Cutting shall take place throughout the city limits of Appleton on private property at locations as determined by the Weed Commissioner. Specific cutting instructions for each location will be furnished to the Contractor through a series of Work Orders and could include portions of City terraces (the area between the curb and sidewalk). The successful bidder will be required to sign a contract and comply with the insurance requirements as set forth within the attached document identified as IR 2.1, Small Exposure Jobs. The successful contractor will also be required to provide the City of Appleton with their tax identification number prior to the City of Appleton issuing any payments under this contract. The successful contractor will agree to indemnify, defend and hold harmless the City of Appleton and its offices, officials, employees and agents from and against any and all liability, loss, damage expense, costs including attorney fees arising out of the work performed as described herein caused in whole or in part by any negligent act or omission of the contractor, any subcontractor, anyone directly or indirectly employed by any of them or anyone for whose acts any of them may be liable, except where caused by the sole negligence or willful misconduct of the City of Appleton. Bond Requirements o Bid Bond: The Contractor's Bid Bond equal to 5% of the contract shall accompany the bid for the project. o Payment and Performance Bond: If awarded the contract, the Contractor will provide to the Owner a Payment and Performance Bond in the amount of the contract price, covering faithful performance of the contract and payment of obligations arising thereunder, as stipulated in bidding requirements, or specifically required in the contract documents on the date of the contract's execution. The City reserves the right to adjust payment in circumstances where work is not adequately documented by the Contractor.
