Renovation of a water / sewer project in San Jose, California. Completed plans call for the renovation of a water / sewer project.
The Project generally involves replacing existing 36-inch check valve with new 36-inch butterfly valve. Bidders must submit questions or requests for information concerning any part of this bid in writing to the City online The City will not respond to any communication or question submitted directly to City staff or City consultants. Submit questions no later than Monday, May 9, 2022, at 3:00 pm. Any bidder who violates this policy will be subject to disqualification. The grounds for disqualification include contact regarding this procurement with any City official or employee or evaluation team member other than the Procurement Contact or Purchasing Officer from the time of issuance of this solicitation until the end of the protest period. MINOR PUBLIC WORK This project is a Minor Public Work being procured in accordance with San Jose City Charter Section 1217(d) and San Jose Municipal Code Section 27.06.050. As such, the following provisions apply: Bid security is not required for this project. The contract for this project can only be awarded if the lowest responsive and responsible bid is less than $650,000. If that threshold is exceeded, the City will reject all bids and decide whether to re-bid the project. The Local and Small Business Preference requirements of Chapter 4.12 of the San Jose Municipal Code apply to this project. In order for a contractor to be a Local Business Enterprise (LBE) the contractor must have a current San Jose Business Tax Certificate Number and have an office located in Santa Clara County with at least one employee. If a contractor qualifies as an LBE the contractor can also qualify as a Small Business Enterprise (SBE) if the total number of employees (regardless of where they are located) of the firm is 35 or fewer. This project is a "public works" as defined in Sections 1720 through 1720.6 of the California Labor Code. In accordance with Chapter 14.09 of the San Jose Municipal Code entitled "Prevailing Wage Requirements for City Contracts Involving Public Works," the contractor will be required to comply with the prevailing wage provisions in California Labor Code Sections 1720 through 1861, and the City's Office of Equality Assurance is authorized to provide certain local enforcement of those provisions. As such, the contractor will need to pay not less than the general prevailing rate of per diem wages and the general prevailing rates for holiday and overtime work. Bidder's attention is directed to those provisions of the Specifications which require the contractor to whom the contract for the work is awarded, to file with the City Clerk at the time the contract is executed, a Contractor's Payment Bond and a Bond for Faithful Performance meeting all the requirements of the Specifications and approved by the City Attorney of the City of San Jose. Bonds shall be executed by a surety possessing a valid certificate of authority issued by the California Department of Insurance and shall name the City of San Jose as beneficiary. The Contractor's Faithful Performance Bond shall be for 100% of the contract amount. The Contractor's Payment Bond shall be for 100% of the contract amount.
