Bidders on this work will be required to comply with the Federal cross-cutting requirements, including, but not limited to, DBE requirements found at 40 CFR 33; OSHA Worker Health & Safety Standard 29 CFR 1910.120; the Uniform Relocation Act; National Historic Preservation Act; Endangered Species Act; and Permits required by Section 404 of the Clean Water Act; Executive Order 11246, Equal Employment Opportunity, and implementing regulations at 41 CFR 60-4; Contract Work Hours and Safety Standards Act, as amended (40 USC, 327-333) the Anti-Kickback Act (40 USC, 276c) and Section 504 of the Rehabilitation Act of 1973 as implemented in Executive Orders 11914 and 11250. Bidders on this work will be required to comply with Title 40 CFR 33. The requirements for bidders and contractors under this regulation which concerns utilization of Disadvantaged/Minority Business Enterprises (DBE/MBE) and Womens Business Enterprises (WBE) are explained in the specifications. The DBE/MBE and WBE goals for participation in this contract in terms of percentage of contract value are as follows: MBE: Construction 1.0 percent; Supplies 1.0 percent; Services 1.0 percent; Equipment 0.0 percent and WBE: Construction 4.0 percent; Supplies 6.0 percent; Services 3.0 percent; Equipment 5.0 percent The work under this contract is subject to the provisions of the Davis-Bacon and Related Acts, as published in the U.S. Department of Labor regulations (29 CFR Parts 1, 3 and 5). The work under this contract is subject to the Rosebud Sioux Tribe Employment Rights Office (TERO) Ordinance No. LB-87-A, the Tribal Employment Rights Ordinance. The Owner reserves the right to reject any or all bids and to waive any irregularities therein. Bidders proposal shall hold firm for thirty (30) days for the date of opening. Work shall be commenced within ten (10) consecutive calendar days after written Notice to Proceed by the Owner and shall be substantially completed and ready on or before August 31, 2022.
