Renovation of a mixed-use development in Waimanalo, Hawaii. Completed plans call for the renovation of a educational facility.

It is the offeror's responsibility to read and comply with any Specifications, Instructions, Special Provisions, and Terms & Conditions that may be attached or referenced in this solicitation. In accordance with the SOSA for HePS, the Awarded Vendor shall pay a Transaction Fee of 0.725% (.00725), capped at $5,000, to SicommNet on the total dollar amount of goods or services purchased through the Hawaii Electronic Procurement System (HePS). Unless otherwise indicated in this solicitation, the Transaction Fee shall apply to all purchases, whether through the Purchase Order, Contract, or eCatalog regardless of the quantity or dollar amount of the purchase. Payment shall be made by the Awarded Vendor to SicommNet within thirty (30) days from receipt of invoice. The SOSA is hereby incorporated by reference into this Electronic Solicitation as if set forth herein in its entirety, and is located on the Internet. Failure by any Vendor to obtain a copy of the SOSA shall in no way constitute or be deemed a waiver by the HePS Contractor or the Department of Education for a vendor's failure to consider this document in its response to the Electronic Solicitation. Only responses submitted through the HePS shall be considered for award. Submission of an electronic response to the State of Hawaii constitutes and shall be deemed an offer to sell the specified goods and/or services to the State of Hawaii at the price shown in the response and under the State's Terms and Conditions. The electronic response submitter certifies that he/she is authorized to sign the response for the submitting vendor and that the response is made without connection with any person, firm, or corporation making a response for the same goods and/or services and is in all respects fair and without collusion or fraud. Vendors are required to be compliant with all appropriate state and federal statutes. Proof of compliance (compliance documentation) is required. Proof of compliance/documentation is obtained through Hawaii Compliance Express (HCE). Vendors shall register in Hawaii Compliance Express (HCE), a program separate from HePS. The annual subscription fee to utilize the HCE service is currently $12.00. Allow 2 weeks to obtain complete compliance status after initial registration. It is highly recommended that vendors subscribe to HCE prior to responding to a solicitation. The vendor is responsible for maintaining compliance. If the vendor does not maintain timely compliance in HCE, an offer otherwise deemed responsive and responsible may not be awarded. State agencies may check HCE for compliance at any time. Non-compliance may result in a vendor not receiving an award, delay of payment, or cancellation of award. Register online for HCE. This solicitation contains attachments that bidders must download (open, save, or print document(s) on their own computer system), enter pricing where indicated, complete any other required information, sign all appropriate forms, and attach (upload) the completed forms to the HePS online response. All awardees for this solicitation are subject to and shall comply with the INTERIM GENERAL CONDITIONS,1999 EDITION of the Department of Accounting and General Services, or the General Conditions (AG-008 103D) of the Department of the Attorney General, as applicable. It is the Vendor's responsibility to read and comply with these General Conditions and other documents or specifications for the solicitation whether attached or referenced. This Solicitation is for procurement as set forth in Section 103D, Hawaii Revised Statutes (HRS), Chapter 3-122, Hawaii Administrative Rules (HAR) and Act 175, SLH 2009. 2. Contractor License: Bidder may be required to furnish a copy of its valid State of Hawaii contractors license as a condition for the award of the contract. The license shall list the classification as required in this Solicitation. 3. Subcontracting Percentage Form: If applicable, the winning bidder shall complete and submit the Subcontracting Percentage Form as a condition for the award of the contract. Bidder is recommended to submit it as an attachment with its bid. 4. General Conditions: Section 00700 General Conditions and the Interim General Conditions, 1999 Edition, is incorporated by reference and hereto made a part of this Solicitation, including the following amendments: a. In the Interim General Conditions, under Article 2 Proposal Requirements and Conditions, delete section 2.8 Bid Security. b. In the Interim General Conditions, under Article 3 Award and Execution of Contract, delete requirements for payment bonds in section 3.7 Requirement of Performance and Payment Bonds. c. In the Interim General Conditions, under Article 3 Award and Execution of Contract, revise section 3.10 Notice to Proceed, paragraph 3.10.1 by adding an ending sentence to read State Purchase Order will be issued as the Notice to Proceed in lieu of a formal Notice to Proceed letter. d. In the Interim General Conditions, under Article 7 Prosecution and Progress, revise section 7.7 Prevailing Wages, paragraph 7.7.2 by adding a sentence to read Said wage rate schedule may also be obtained website. In accordance with the Interim General Conditions, under Article 2 Proposal Requirements and Conditions, section 2.5 Addenda and Bid Clarifications, paragraph 2.5.5, Upon providing an addenda, all bidders shall be deemed to be on notice of the information therein whether or not the addendum or bid clarification is actually received. All addenda and bid clarifications so issued shall become part of the Contract Documents. Section 00700 General Conditions and The Interim General Conditions. Bid Evaluation Criteria and Method of Award: The Bid Evaluation Criteria and Method of Award are hereby incorporated by reference and hereto made a part of this Solicitation. Performance Bond: Bidder shall furnish a performance bond as a condition for the award or higher. The bond shall conform to the provisions of HRS Sections 103D-324 and 325, Section 3.7, Interim General Conditions, and any law applicable thereto. 7. Liquidated Damages: In accordance with the Interim General Conditions, Article 7 Prosecution and Progress, Section 7.26 Failure to Complete the Work On Time, upon failure to complete the work or any portion of the work within the time or times fixed in the contract or extension thereof, the Contractor shall pay liquidated damages to the State, in the amount of $100, per calendar day of delay for contracts less than $50,000, or in the amount of $200, per calendar day of delay for contracts $50,000 or higher, unless otherwise noted. 8. Okada Trucking Decision: "A" general engineering contractors and "B" general building contractors are reminded that due to the Hawaii Supreme Court's January 28, 2002 decision in Okada Trucking Co., Ltd. v. Board of Water Supply, et al., 97 Haw. 450 (2002), they are prohibited from undertaking any work, solely or as part of a larger project, which would require the general contractor to act as a specialty contractor in any area where the general contractor has no license. Although the "A" and "B" contractor may still bid on and act as the "prime" contractor on an "A" or "B" project (See, HRS 444-7 for the definitions of an "A" and "B" project.), respectively, the "A" and "B" contractor may only perform work in the areas in which they have the appropriate contractor's license (An "A" or "B" contractor obtains "C" specialty contractor's licenses either on its own, or automatically under HAR 16-77-32.). The remaining work must be performed by appropriately licensed entities. It is the sole responsibility of the contractor to review the requirements of this project and determine the appropriate licenses that are required to complete the project." 9. The apparent low bidder shall furnish the required documents to the Department within 10 calendar days from the close of bids. If valid documents are not submitted on a timely basis for award of the contract, a bidder otherwise responsive and responsible may not receive the award. Bidder is responsible to apply for and submit the documents by the required deadlines. Project is tentatively scheduled to commence upon award of contract and must be completed by June 30, 2022.
