The project work includes cold-in-place pavement remediation of approximately 2.2 miles of various roads and associated miscellaneous work. Roads include; Albany Street (portion), Beverly Road, Buena Vista Avenue, Clearview Avenue, Elmira Avenue, and Whitewood Road. A bid bond in an amount not less than five percent (5%) of the amount of the bid shall accompany each bid. A noncollusion statement for Prime Contractor and any addendum acknowledgement must also be submitted at the time of the bid. A performance, labor, and materials bond in an amount equal to one hundred percent (100%) of the accepted bid will be required No interpretation of the meaning of the plans, specifications or other pre-bid documents will be made to any bidder orally. All written requests for interpretations must be emailed to Purchasing Agent Pennie Zucco at Pennie_Zucco@torringtonct.org. All requests for such interpretation must be in writing to be given consideration for a reply and must be received by 12:00 noon seven (7) working days prior to the bid opening The successful bidder and City recognize that time is of the essence of this Agreement. The parties also recognize that the delays, expense, and difficulties involved in proving in a legal or arbitration preceding the actual loss suffered by the City if the Work is not completed on time. Accordingly, instead of requiring any such proof, the City and successful bidder agree that as liquidated damages for delay (but not as a penalty), successful bidder shall pay City $1,000.00 for each day that expires after the Contract Completion date, that work is not complete. Inclement weather conditions shall not be a reason for not completing all work within the specified contract time. Any inclement weather days occurring during the contract time period is to be included in the total count of contract days. The CONTRACTOR shall be substantially complete with the project work within 60 calendar days of the date on the Notice to Proceed. The CONTRACTOR shall have an additional 5 calendar days after the substantial completion date to have all work completed and ready for final payment. The City of Torrington reserves the right to accept or reject any or all bids, to waive technicalities, or to award the contract to a bidder other than the lowest bid, and to award the contract as it feels will best serve the public interest. All bids will be considered valid for a period of sixty (60) days.
