Site work and paving for a playground / park / athletic field in Mariposa, California. Completed plans call for site work for a playground / park / athletic field; and for paving for a playground / park / athletic field.
The work includes an acrylic color coating system over prepared asphalt concrete pavement. The work to be done consists, in general, of removing existing chain link fabric and vertical line posts, demolishing net posts, nets, center anchors including concrete footings, constructing new post sleeves, posts, and nets, digging out root heaves, cleaning the surface of loose dirt and debris, crack filling, 2 HMA overlay, and applying resurfacer, color playing surface, and line paint using a Plexipave surfacing system or equivalent. The project requires prevailing wage and DIR registration. Contractor must possess a current Class A or combination of C Licenses. Technical questions should be directed to Matt Hespenheide - mhespenheide@mariposacounty.org All bids shall be accompanied by a bidder's bond amounting to ten percent (10%) of bid amount payable to said County as liquidated damages. Said amount shall be retained by, or said bond shall become payable to said County if the bidder depositing same does not, within 10 working days after written notice that the contract has been awarded to him, enter into a contract with the County. All bid questions or request for information will be addressed in issued project Addenda without delay as long as they are submitted at least 3 working days prior to the bid close. The successful bidder shall, after Notice of Award, furnish a payment bond and a performance bond, each in the amount of one hundred percent (100%) of the contract price. Contractor shall pay prevailing wages to its employees on any contract in excess of $1,000.00 (one thousand dollars). Copies of the prevailing rate of per diem wages are on file at Owner's principal office. Contractor shall comply with the 8-hours per day/40 hours per week/overtime/working hours restrictions for all employees, pursuant to the California Labor Code. Contractor and all subcontractors shall keep and maintain accurate employee payroll records for Work performed under the Agreement. The payroll records shall be certified and submitted as required by law, including Labor Code Section 1771.4 (if applicable) and 1776, including (if the Agreement is awarded on or after April 1, 2015 or continues on or after January 1, 2016) to the Labor Commissioner no less frequently than monthly. Contractor shall comply fully with Labor Code Section 1777.5 in the hiring of apprentices for work relating to the Agreement. If the Agreement exceeds $2,000 and is funded with federal funds, then Contractor shall pay federal Davis Bacon wages and comply with applicable federal requirements. Pursuant to Section 1773 of the Labor Code, the general prevailing wage rates in the County in which the work is to be done have been determined by the Director of the California Department of Industrial Relations. These wages are set forth in the General Prevailing Wage Rates for this project, available at the County of Mariposa Department of Public Works and available from the California Department of Industrial Relations As liquidated damages for delay Contractor shall pay Owner Five Hundred dollars ($500.00) for each Day that expires after the time specified herein for Contractor to achieve Substantial Completion of the entire Work, until achieved. As liquidated damages for delay Contractor shall pay Owner Five Hundred dollars ($500.00) for each Day that expires after the time specified herein for Contractor to achieve Final Completion of the entire Work, until achieved. Liquidated damages for delay shall cover administrative, overhead, interest on bonds, and general loss of public use damages suffered by Owner as a result of delay. Liquidated damages shall not cover the cost of completion of the Work, damages resulting from Defective Work, lost revenues or costs of substitute facilities, or damages suffered by others who then seek to recover their damages from Owner (for example, delay claims of other contractors, subcontractors, tenants, or other third-parties), and defense costs thereof. Owner may deduct from any money due or to become due to Contractor subsequent to time for completion of entire Work and extensions of time allowed pursuant to provisions hereof, a sum representing then-accrued liquidated damages. The Contractor waives any and all rights to any type of express or implied indemnity against the County, its elected and appointed officials, employees, agents and volunteers, it is the intent of the parties that the Contractor will indemnify, defend, and hold harmless the County, its elected and appointed officials, employees, agents and volunteers from any and all claims, suits or actions as set forth above regardless of the existence or degree of fault or negligence whether active or passive, primary or secondary, on the part of the County, the Contractor, the subcontractor or employee of any of these.
