Alum Rock Union School District ("District") will receive sealed bids for the following project, Summer Projects - Repair and/or Replace Play Structure Surface at San Antonio ES and Adelante I ES Prior to publicly reading aloud bids at the video conference, the district reserves the right to verify the genuineness of any bid security. Bidders must submit with their Bids a legible photocopy of (i) a cashier's check or (ii) a certified check payable to District, or (iii) a bid bond by an admitted surety insurer of not less than ten percent (10%) of amount of base Bid, plus all additive alternates ("Bid Bond"). The successful Bidder shall be required to furnish a 100% Performance Bond and a 100% Payment Bond if it is awarded the contract for the Work. The successful Bidder may substitute securities for any monies withheld by the district to ensure performance under the Contract, in accordance with the provisions of section 22300 of the Public Contract Code. All questions about the meaning or intent of the Contract Documents are to be directed via email to jlarson@kleinfelder.com. Interpretations or clarifications considered necessary by the district in response to such questions will be issued in writing by Addenda and emailed, to all parties recorded by the district as having received the Contract Documents. Questions received less than THREE (3) calendar days prior to the date for opening Bids may not be answered. Only questions answered by formal written Addenda will be binding. Oral and other interpretations or clarifications will be without legal effect. The Board reserves the right to reject all bids and/or waive any irregularity in any bid received. Unless otherwise required by law, no bidder may withdraw its bid for ninety (90) days after the date of the bid opening.
