The Contractor hereby agrees that the City of Twinsburg shall be and is hereby authorized to deduct and retain, out of monies which may be due or to become due to the Contractor under this Contract, as liquidated damages, the amounts which are called for elsewhere in the Contract, for the non-completion of work by the interim dates, or time stipulated, and the project completion date, including any approved time extensions. This sum is not to be construed as a penalty. The City reserves the right to reject/disqualify any and all bids according to ODOT Item 102.14 or advertise for new Bids without liability to the City.
