2022 Sewer Line Replacement Project Each Proposal shall be accompanied by an acceptable form of Proposal Guaranty in an amount equal to at least 5% of the amount of the Proposal payable to the City of Erick as a guaranty that if the Proposal is accepted, the BIDDER will execute the Contract and file acceptable Performance and Statutory Bonds within 10 days after the award of the Contract. Each Proposal shall be accompanied by a Certified Check or Bid Bond, in an amount equal to 5% of the Proposal, payable without condition to the OWNER as a guaranty that the BIDDER, if awarded the Contract, will promptly execute the Agreement in accordance with the Proposal and the other Contract Documents, and will furnish good and sufficient Bond for the faithful performance of the same, and for the payment to all persons supplying labor and material for the work. The successful BIDDER, simultaneously with the execution of the Contract, will be required to furnish a faithful Performance Bond in an amount equal to 100% of the Contract Amount and a Statutory Bond made payable to CLIENT equal to 100% of the Contract Amount; said Bonds shall be secured from a Surety Company listed in the Federal Registry, Department of the Treasurer, Fiscal Service Listing. The CONTRACTOR shall provide a 1-year Maintenance Bond for all improvements in the amount of 15% of the Contract Cost of improvements. Liquidated damages for failure to complete the work within the time specified shall be assessed at the rate of $250 per day for each additional calendar day until the work is completed. The City of Erick hereinafter called the OWNER, reserves the right to reject any or all Proposals and to waive any formality or technicality in any Proposal in the interest of the OWNER.
