Crack Sealing - Asphalt Fiber Compoundincluding but not limited to preparation of cracks, furnishing and applying asphalt fiber compound crack seal and other miscellaneous work including traffic control during construction. Only prospective bidders pre-qualified by the Commonwealth of Massachusetts Highway Department, pursuant to Section 8B of Chapter 29 of the Massachusetts General Laws, are eligible to take out official bid documents. Each bid must be accompanied by a bid deposit in the amount of 5% of the bid. Such deposit shall be in the form of a certified, treasurer's or cashier's check made payable to the Town of Upton or a bid bond in a form satisfactory to the Town of Upton with a surety company qualified to do business in the Commonwealth of Massachusetts and conditioned upon faithful performance by the principal of the agreements contained in the bid. Return of bid deposits will be in accordance with the provisions of the applicable General Laws. All bid bonds shall be retained by the Town of Upton unless accompanied by a stamped, self-addressed envelope. The awarding authority is the Town Manager who reserves the right to reject or split all bids if deemed to be in the best interests of the Town of Upton. Before execution of an agreement, the Town will require a labor and materials bond in an amount of 50 percent of the total amount of the bid with a surety company qualified to do business in the Commonwealth of Massachusetts. Attention is directed to the minimum wage rates to be paid as determined by the Commissioner of Labor and Industries under the provisions of Massachusetts General Laws, Chapter 149, Section 26 and 27D inclusive.
