This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulation (FAR) Subpart 12.6, and under the authority of FAR Part 13, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotations are being requested, and a written solicitation document will not be issued. This solicitation, No. 192122FHQIHSCTDON.01, and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2022-07. The ICE Office of Acquisition Management (OAQ) anticipates that this combined synopsis/solicitation will result in award of a Firm-Fixed Price (FFP) Purchase Order (PO). This acquisition is a 100% Small Business set-aside and quotes will only be accepted from current Small Businesses certified in the System for Award Management (SAM) as SBs for North American Industry Classification System (NAICS) code 238220 - Plumbing, Heating, and AirConditioning Contractors with a small business size standard of $16,500.00. The Product Service Code (PSC) is N041 - Installation of Equipment--Refrigeration, Air Conditioning, and Air Circulating Equipment. Attachment(s): 1. Attachment 1 - Statement of Work (SOW) 2. Attachment 2 - Terms and Conditions 3. Attachment 3 - Quoter Questions 4. Attachment 4 - Davis Bacon Wage Determination TX20220275 Modification 9 1. DESCRIPTION 1.1. Description: DHS/ICE requires support services for removal, disposal, and installation of two (2) HVAC units as described in Attachment 1 - SOW. 1.2. Place of Contract Performance: The place of performance will be at the T. Don Hutto Facility, 1001 Welch St., Taylor, TX 76574. 1.3. Period of Performance: IHSC requires removal, disposal, delivery, and installation of the HVAC units within 60 calendar days of award. 2. SOLICITATION GENERAL INFORMATION 2.1. General Conditions. The ICE OAQ is releasing this RFQ in electronic format only. The Government will not be obligated to pay any costs incurred by an quoter in preparation and submission of a quote in response to this solicitation. A quoter who includes data in their quote that it does not want disclosed to the public for any purpose, or used by the Government except for evaluation purposes, shall prepare text conforming to paragraph (e) of the provision at FAR 52.215-1, Instructions to Offerors - Competitive Acquisition. Quoters shall fully understand and accept these terms, as well as all other terms and conditions stated herein, before deciding whether to participate in this solicitation. 3. SOLICITATION SUBMISSION INSTRUCTIONS 3.1. Submissions. Unless otherwise indicated in this solicitation, all submissions shall be provided electronically to the POC(s) listed above. Electronic copies shall be formatted using Microsoft Office with file names that are consistent with the structure of the quote. All submissions must include the RFQ number in the subject line of the e-mail. Omission of any information from these submission requirements may result in rejection of the quote. 3.2. RFQ Questions. The cutoff date for questions relating to this RFQ is listed above. Quoters shall email questions utilizing Attachment 3 - Quoter Questions to the POC above. Questions submitted after the cutoff date may be responded to at the discretion of the Contracting Officer (CO). Please be advised that the Government reserves the right to publish those questions and answers to all prospective quoters. As such, quoter's should refrain from including proprietary information in their questions. 3.3. Submission Due Date. Quotes shall be emailed to the POC above. Submissions must be received no later than the date prescribed above. Late submissions will not be accepted or evaluated. 3.4. Quote Preparation. Quoters shall follow the below quote preparation instructions. 3.4.1. Page Limitations. The title page, table of contents, table of figures, list of tables and glossary of abbreviations & acronyms do not count against page count limitations. Quote contents that exceed the stated page limitations will be removed from the quote by the CO prior to turning the quote over to the Government evaluation team and will not be considered in the evaluation. 3.4.2. Format. Print shall be on 8 1/2 " x 11" paper (except as specifically noted). Print shall be of a minimum 12-point font. Graphic presentations, including tables, while not subject to the same font size and spacing requirements, shall have spacing and print that is easily readable. All submissions shall be provided electronically. 3.4.3. Volumes and Organization. The quoter shall submit their written response in three (3) separate volumes: Volume I: Quote Summary Volume II: Technical Capability Volume III: Price Pricing data is prohibited in, and shall be omitted from, Volumes I and II. Any conditional assumptions taken with respect to the requirements and the RFQ shall be fully explained in Volume I of the quote. The page limitations shown below do not include any "front matter" information such as a title page, table of contents, definitions, or acronyms. Any Technical Capability information submitted within the "front matter" will not be considered. 3.4.4. Volume I: Quote Summary. The quote shall include the following: a. RFQ Number & Title b. Name and address of quoter c. Name, telephone number & e-mail address of quoter's main point-of-contact d. Socio-economic status, if applicable e. Unique Entity Identifier (UEI) f. All assumptions (for non-price factor and pricing) to the RFQ (including the SOW) must be identified in this section. g. The Government intends to award a purchase order as a result of this solicitation that will include the terms and conditions set forth herein. To facilitate the award process, all quotes must include a statement regarding the terms and conditions herein as follows: "The terms and conditions in the combined synopsis/solicitation are acceptable to be included in the award document without modification, deletion, or addition." OR "The terms and conditions in the combined synopsis/solicitation are acceptable to be included in the award document with the exception, deletion, or addition of the following:" Quoter shall list exception(s) and rationale for the exception(s). h. Quoter provision fill-ins as required in Attachment 2 - Terms and Conditions specifically, but not limited to: i. FAR 52.204-20 ii. FAR 52.204-24 iii. FAR 52.204-26 iv. FAR 52.212-3 v. FAR 52.222-22 vi. FAR 52.222-25 vii. FAR 52.225-4 viii. DHS HSAR 3052.209-70 3.4.5. Volume II: Technical Capability. Within this volume, quoters shall discuss their technical capability and approach to satisfy the requirements outlined in Attachment 1 - SOW. The submission must present sufficient information to reflect a thorough understanding of the SOW requirements and a detailed approach for achieving those requirements. 3.4.6. Volume III: Price. Quoter shall submit a pricing volume that outlines the total cost for all equipment, deliverables, and services outlined in the SOW, i.e. inclusive of all costs associated with this effort utilizing the format below. Pricing shall be formulated in accordance with applicable wage rates outlined in Attachment 4 - Davis Bacon Wage Determination TX20220275 Modification 9. The quoter shall not hide any cost cells and provide viewable formula access to all cells if applicable. CLIN Item Description Quantity Unit of Issue 0001 Removal and disposal of two (2) HVAC units as well as installation and testing of new comparable HVAC units with associated support equipment as described in Attachment 1 - SOW 1 EA 4. BASIS FOR AWARD, EVALUTION FACTORS, AND EVALUATION METHODOLOGY 4.1. Basis for Award. The Government anticipates awarding a single award FFP PO for the requirements described in Attachment 1 - SOW to the quoter whose quote offers the best value to the Government in terms of the evaluation factors described below. The Government intends to evaluate quotes in response to this solicitation using the Lowest Price Technically Acceptable (LPTA) process. Quotes shall be evaluated in order of total price (lowest price first) until a technically acceptable quote is determined. The technically acceptable quote will then have its price quote evaluated for reasonableness. All quotes may not be evaluated at the Government's discretion. 4.2. Evaluation Factors. The Government will evaluate the following factors: Factor 1: Technical Capability (non-price) Factor 2: Price The Government intends to award without discussions; therefore, each initial submission should include the most favorable Technical Capability and Price that the quoter can submit to the Government. However, the Government reserves the right to conduct discussions if later determined by the CO to be necessary. 4.3. Evaluation of Factor 1 - Technical Capability. The quoter's Technical Capability quote will be evaluated for technical acceptability only. A Technical Capability quote shall be determined to be technically acceptable or unacceptable based on the rating definitions in the table below. Note that simple statements of compliance or reiteration (e.g.., "understood"; "will comply", "has the capability to", "well-known techniques will be used"), without a detailed description of how compliance or performance will be met, may not sufficiently demonstrate quoter's ability to meet the requirements and may result in a rating of Unacceptable. Rating Definitions: Acceptable The quote demonstrates that the quoter has a thorough understanding of the requirements outlined in the SOW and a sound technical approach to execute those requirements. Unacceptable The quote does not demonstrate that the quoter has a thorough understanding of the requirements outlined in the SOW and/or a sound technical approach to execute those requirements. 4.4. Evaluation of Factor 2 - Price. The Price quote will not be rated but will be evaluated with respect to reasonableness and completeness. 4.4.1. Reasonableness. The Government will evaluate the total proposed price for reasonableness by utilizing one or more of the following methods: o Comparison to other quotes received. o Comparison and/or analysis based on Independent Government Cost Estimate. o Comparison/analysis to historical prices. o Comparison with competitive published price lists. o Comparison of proposed prices with prices obtained through market research for the same or similar items. 4.4.2. Completeness. The Government's price evaluation will also assess the completeness of the Price quote which involves verification that: o The Price quote utilizes the format prescribed in RFQ Section 3.4.6. o The Price quote outlines the total cost for all equipment, deliverables, and services outlined in the SOW, i.e. inclusive of all costs associated with this effort. o Figures are correctly calculated.
