Bids to be considered must be submitted to the Borough of Rockaway, and must be accompanied by a Bid Guarantee in the form of a Bid Bond, Cashiers Check or Certified Check, made payable to the Borough of Rockaway in the amount of 10% of the highest aggregate ONE year bid submitted, not to exceed twenty thousand dollars ($20,000) must accompany each Bid Proposal. Each bid must also be accompanied by a Consent of Surety by a surety company authorized to do business in the State of New Jersey and approved by the Mayor and Council, to the effect that it will furnish the bonds required by the specifications. The proposal must be delivered or mailed in a sealed envelope marked plainly on the outside, Bid for Solid Waste and Designated Recyclable Materials Collection and Disposal Services and must bear the name, address of the bidder and such other particulars as may be required as to identify the nature of the bid to be presented. If bids are forwarded by mail, the Borough will not assume responsibility for those bids. It is the responsibility of the bidder to see that bids are presented to the Borough Clerk on the hour and at the place designated. The successful bidder shall be required to furnish a Performance Bond in the amount of one hundred (100%) percent of said bid to cover all provisions on the specifications. The Contractor shall not assign, transfer, convey, sublet or otherwise dispose of this contract or any part thereof to anyone without written consent of the Borough of Rockaway, New Jersey. If you, as the bidder, cannot meet our specifications, please list any and all deviations on a separate sheet of paper and attach it to the proposal. Failure to do so may result in our rejecting your bid. The right is reserved by the Mayor and Council to reject any and all bids and to waive informalities or technical defects therein and to accept such bid as shall be in the best interest of the Borough of Rockaway. Each bidder shall be bound by the provisions of Section 3 P.L. 1975, c. 127 and Chapter 33, P.L. 1977. The Contractor shall be required to comply with the New Jersey Prevailing Wage Act and the Davis-Bacon Act. Bidders are required to comply with the equal opportunity provisions of New Jerseys Law Against Discrimination, N.J.S.A. 10:5-31 et seq., and the regulations promulgated thereunder, N.J.A.C. 17:27-1, et seq. All bidders must comply with all applicable laws for the Bid to be deemed in acceptable form. The failure of the Borough to specifically specify a provision of law in this solicitation to bid shall not relieve the Bidder from compliance with the requirements imposed upon bidders by the laws of New Jersey, the Rules and Regulations promulgated under any law, and any other State or Federal Law. Bidders must use, and complete fully, Proposal blanks included with the Specifications furnished by the Borough and comply with all requirements attached thereto including the following: (1) Statement of bidders qualifications, experience and financial ability; (2) A Bid Guarantee in the form of a Bid Bond, Cashiers Check or Certified Check, made payable to the Borough of Rockaway in the amount of 10% of the highest aggregate ONE year bid submitted, not to exceed twenty thousand dollars ($20,000) must accompany each Bid Proposal; (3) A Non-Collusion Affidavit; (4) A Consent of Surety; (5) A Stockholder Statement of Ownership pursuant to Chapter 33 P.L. 1977; (6) Business Registration Certificate shall be provided prior to the time the contract is awarded, which must be dated prior to the bid opening; (7) Disclosure of Investment Activities in Iran. Simultaneously with the submission of Bids, the corporation or partnership so bidding shall furnish a statement setting forth the names and addresses of all stockholders in the corporation or the partnership who own 10% or greater of interest therein pursuant to Ch. 33, P.L. 1977. The Borough also reserves the right to correct any erroneous mathematical computations in any proposals submitted, and to consider the Bid on the basis of the corrected total or totals. The written figures shall prevail over the numerical figures. This proposal is being solicited through a fair and open process in accordance with N.J.S.A. 19:44A-20.5 et seq. The Bidder shall comply with the requirements mandated by law.
