This contract is for a public work. Contractor and subcontractor shall pay all workers on the project at least the general prevailing rate of per diem wages as determined by the Director of the Department of Industrial Relations ("DIR") pursuant to Labor Code sections 1770 et seq. No contractor or subcontractor may be listed on a bid or awarded a contract for public work unless currently registered with the DIR pursuant to Labor Code section 1725.5. This project is subject to compliance monitoring and enforcement by the DIR. Each bidder shall be a licensed contractor at the time the bid pursuant to the Business and Professions Code and such license(s) shall remain active and good standing for the duration of the contract. Such bidder's security must be in an amount not less than ten percent (10%) of the maximum amount of such bidder's bid as a guarantee that the bidder will enter into the proposed contract, if the same is awarded to such bidder, and will provide the required Performance Bond and Payment Bond. In the event that a bidder is awarded the contract and such bidder fails to enter into said contract or provide the necessary documents within five (5) calendar days after notification of the award of the contract to bidder, said security will be forfeited The Agreement form which the successful bidder, as CONTRACTOR, will be required to execute, and the form of the bonds which such CONTRACTOR will be required to furnish, are included in the contract documents and should be carefully examined by the bidder.
