A proposal guaranty shall accompany each bid. The guaranty shall be either a bid bond (executed on the form furnished by the Owner), cashier's check, certified check, or other negotiable instrument equivalent to (5) percent of the amount of the bid, as assurance that the bidder will, upon acceptance of his/her bid, execute the Contract and cause to be executed a Performance Bond and Payment Bond, acceptable to the Owner, within 10 calendar days following notice of contract award. The successful bidder will be required to submit a Certification of Nonsegregated Facilities prior to award of the contract, and to notify prospective subcontractors of the requirement for such a Certification, where the amount of the subcontract exceeds $10,000. The City of Stuttgart reserves the right to reject any or all bids and to waive formalities, except for conditions affecting Executive Order 11246.
