All questions about the meaning or intent of the bidding documents are to be submitted to Engineer (Heath Hardy PE, HDR Inc.) in writing via email at heath.hardy@hdrinc.com up to seven (7) days prior to the bid opening. Interpretations or clarification considered necessary by the Engineer in response to such questions will be issued by addenda to the ECUA website to all parties registered to receive documents about this bid via the website. Questions received less than seven (7) calendar days prior to the date for the opening of bids will not be answered. Only questions answered by addenda will be binding. Oral and other interpretations or clarifications will be without legal effect. The Emerald Coast Utilities Authority reserves the right to waive informalities in any bid; reject any or all proposals, in whole or in part; re-bid a project, in whole or in part; and to accept a proposal that in its judgment is the lowest and best bid of a responsible bidder. In accepting a bid, ECUA may award a contract based only on the base bid, the base bid plus all alternates, or the base bid plus any alternates which ECUA selects, with all decisions being made based upon what ECUA believes to be the best interests of its ratepayers, in the reasonable exercise of its discretion. ECUA further reserves the right to increase or decrease quantities as may be required to meet the needs of ECUA, at the unit price which was bid.
