The Project includes the following Work: The work for this Project generally includes, but is not limited to, the installation of Americans with Disabilities Act (ADA) compliant pedestrian access ramps at ten (10) intersections in the Borough. This work will be completed under two separate contracts. Bids are requested for the following Contracts: Contract 23-19 Contract 23-20 Bid security in the form a Certified Check or Bid Bond shall be furnished with the bid in an amount not less than 10%. All questions about the meaning or intent of the Bidding Documents are to be submitted via portal. in accordance with the Instructions to Bidders. Telephone inquiries are unacceptable. For all further requirements regarding bid submittal, qualifications, procedures, and contract award, refer to the Instructions to Bidders that are included in the Bidding Documents. Statutory Requirements. Bidders must comply with all State antibid-rigging regulations pertaining to work associated with this project, and will be required to submit an executed non-collusion affidavit with the bid. Bidders should refer to provisions of federal and state statutes, rules and regulations dealing with the prevention of environmental pollution and preservation of public natural resources that affect the project, pursuant to Act No. 247 of the General Assembly of the Commonwealth of Pennsylvania, approved October 26, 1972. This Project falls under The Commonwealth of Pennsylvania enacted Act 127 of 2012, known as the Public Works Employment Verification Act ('the Act') which requires all public work contractors and subcontractors to utilize the Federal Government's E-Verify system to ensure that all employees performing work on public work projects are authorized to work in the United States. All Bidders are required to submit a Public Works Employment Verification Form as a precondition for the Contract Award. The estimated cost of this Project is greater than Two Thousand Dollars ($2,000) and the federal Davis-Bacon Act shall apply. Bidders must comply with all State anti-bid rigging regulations pertaining to work associated with this Project, and will be required to submit a fully completed and executed Non-Collusion Affidavit with the bid. Davis-Bacon and Related Acts also apply to this Project. This Project falls under The Commonwealth of Pennsylvania enacted Act 127 of 2012, known as the Public Works Employment Verification Act ('the Act'), which requires all public work contractors and subcontractors to utilize the Federal Government's E-Verify system to ensure that all employees performing work on public work projects are authorized to work in the United States. The Owner is utilizing federal funds for this project, and has adopted a Minority and Women Business Enterprise (MBE/WBE) Plan in accordance with Executive Orders 11625, 12138, and 12432 and a Section 3 Action Plan as required by Title 24 CFR Part 135. As such, the bidders must submit documentary evidence of minority and women business enterprises and Section 3 business concerns who have been contacted and to whom commitments have been made. Documentation of such solicitations and commitments shall be submitted concurrently with the bid. Bidders are hereby notified that MBE/WBE firms will be afforded full opportunity to bid without discrimination. The contract documents contain requirements addressing prevailing labor wage rates, labor standards, nondiscrimination in hiring practices, goals for minority and female participation, MBE and WBE participation, participation by Section 3 residents and businesses, and related matters. Bidders should refer to provisions of federal and state statutes, rules and regulations dealing with the prevention of environmental pollution and preservation of public natural resources that affect the project, said provisions being pursuant to Act No. 247 of the General Assembly of the Commonwealth of Pennsylvania, approved October 26, 1972. In addition to the Equal Employment requirements of Executive Order 11246 regarding discrimination, the Contractor must establish a 6.9% goal for female participation and a 1% goal for minority participation in his/her aggregate on-site construction force for contracts in excess of $10,000. Moreover, the Contractor shall strive to meet the MBE goal of 5% and the WBE goal of 3% for contracts of $25,000 or more. The Section 3 Action Plan applies to contracts of $100,000 or greater and requires the Contractor to strive to meet the minimum participation level of 10% of the contract amount to be awarded to Section 3 business concerns, and 30% of all new hires shall be Section 3 residents. The Owner, in accordance with its Section 3 Action Plan, may provide a bid preference to a bidder who is a Section 3 business concern. Section 3 requires that the Contractor must utilize, to the greatest extent feasible, local area businesses, trainees, employees, and low-moderate income persons within the general trade area. All bidders are hereby notified that in regard to any contract pursuant to this advertisement, businesses will be afforded full opportunity to submit bids in response to this notice and will not be subjected to discrimination on the basis of gender, race, color, creed, sex, age, physical disability or national origin in consideration for an award. Similarly the successful bidder shall in no manner discriminate against or intimidate any employee involved in the manufacture of supplies, the performance of work, or any other activity required under the contract on account of gender, race, creed or color. All bids shall be irrevocable for 60 days after the bid opening date unless award is delayed by a required approval of another government agency, the sale of bonds, or the award of a grant or grants, in which case this Bid shall remain subject to acceptance for 120 days after the bid opening date as provided by the Act of November 26, 1978 (P.L. 1309, No. 317), as amended by the Act of December 12, 1994 (P.L. 1042, No. 142). The Borough of Littlestown reserves the right to waive any defects, errors, omissions, mistakes, informalities, to accept any bid or combination of bids that are deemed to be in the best interest of the Borough, and to reject any or all proposals. Owner on its own initiative may issue Addenda to clarify, correct, supplement, or change the Bidding Documents. 7.02 Bidder shall submit all questions about the meaning or intent of the Bidding Documents to Engineer in writing.
