NOTICE INVITING BIDS DISTRICT West Park Elementary School District PROJECT West Park Elementary School Modernization PLACE OF BID RECEIPT & OPENING West Park Elementary School District District Office 2695 S. Valentine Avenue, Fresno, CA 93706 NOTICE IS HEREBY GIVEN that the West Park Elementary School District of Fresno County, acting by and through its Board of Trustees ("District"), will receive up to, but not later than the above-noted date and time, sealed bids for the award of a contract for its West Park Elementary School Modernization Project 1. Brief Project Description: The Project consists of the modernization and upgrade of the West Park Elementary School campus, located at 2695 S. Valentine Avenue, Fresno, CA 93706 ("Site"), including but not limited to patch roofing, painting, HVAC, technology, signal systems, ADA compliance, interior finishes, and site utilities. 2. Contract Documents: You may download Contract Documents (including Plans and Specifications) online from the Central California Builders Exchange, If you are not able to obtain them from your local builder's exchange, you may contact the Architect, Integrated Designs by SOMAM, Inc., 6011 N. Fresno Street, Suite 130, Fresno, CA 93710; Telephone: (559) 436-0881. 3. Each Bid must be made and presented on the Bid Form provided by District, must conform and be responsive to the Contract Documents and must be submitted prior to the deadline indicated above, at which time it will be opened and publicly read aloud. Any bid that is submitted after this time shall be non-responsive and returned to the bidder. The sealed envelope shall be plainly marked with the bidder's name, bidder's California Contractor's License Number, and the project name set forth above. Any requests for information (RFI) or clarification must be in writing and must be submitted, no later than February 15, 2023 @ 10:00 a.m., to the Architect, Integrated Designs by SOMAM, Inc., 6011 N. Fresno Street, Suite 130, Fresno, CA 93710; Telephone: 559.436.0881; Fax: 559.436.0887. In addition to the properly completed Bid Form, the envelope must include all documents and certificates required under the Contract Documents, including the following: (1) a bid bond by an admitted surety insurer on the form provided by the District, cash, or a cashier's or certified check, drawn to the order of the District, in the amount of ten percent (10%) of the total bid price as a guarantee that, if awarded the Work, the Bidder will enter into a contract with the District for the performance of the Work as contemplated in the Contract Documents; (2) a completed "Non-collusion Affidavit"; (3) a completed Disabled Veteran Business Enterprise Certification; and (4) "Designation of Subcontractors" as required by the Subletting and Subcontracting Fair Practices Act, Public Contract Code, commencing with Section 4100. Any claim by a bidder of error in its bid must be made in compliance with section 5100 et seq. of the Public Contract Code. 4. The contract is for a public work. In accordance with the provisions of the Labor Code, commencing with Section 1720, the successful bidder and all of its subcontractors of all tiers shall pay all workers on all work performed under this contract not less than the general prevailing rate of per diem wages and the general prevailing rate for holiday and overtime work, as determined by the Director of the Department of Industrial Relations (DIR) of the State of California. Prevailing wage rates are available from the District or at http://www.dir.ca.gov. Pursuant to Labor Code Section 1771.4, Contractor shall post copies of the prevailing wage rates at the job site and is also required to post certified payroll records compliant with Labor Code Section 1776 electronically to the DIR website on at least a monthly basis. The project is subject to compliance monitoring and enforcement by the DIR. No contractor or subcontractor may be listed on a bid proposal or awarded a contract for public work unless currently registered with the DIR pursuant to Labor Code section 1725.5. No bid from a debarred contractor or subcontractor shall be accepted. 5. The successful bidder must possess a valid and active State of California Class B General Contractor's license at the time of the award of the contract. Subcontractors shall be licensed pursuant to California law for the trades necessary to perform the Work called for in the Contract Documents. The bid of a Bidder who does not possess the requisite Contractors' License, or who includes subcontractors who do not possess the requisite licenses, will be rejected for non-responsiveness. 6. The successful Bidder shall file a payment and performance bond issued by an admitted Surety authorized to conduct business in California, in the form set forth in the Contract Documents. At the request and expense of Bidder, pursuant to Public Contract Code Section 22300, Bidder may substitute securities for any monies withheld by the District to ensure performance. 7. In accordance with Education Code Section 17076.11, the successful bidder will be required to either meet the disabled veteran business enterprises ("DVBE") goal of three percent (3%) participation or demonstrate its good faith effort to solicit DVBE participation in this Contract if awarded the contract for the Work. 8. This contract includes additive bid alternates. If a contract is awarded, it may be awarded, at the election of the Board of Trustees, to the lowest responsible bidder on the base bid. 9. All work must be completed as specified as the time allotted in the contract agreement for duration, including updates and revisions as made by the Construction Manager. Time is of the essence. Failure to complete the Work within the time set forth herein will result in the imposition of liquidated damages for each day of delay, in the amount set forth in the Information for Bidders. 10. Upon notification of award, the successful bidder shall execute the Agreement for the Work and provide all documents and certificates required by the Contract Documents and Instructions to Bidders, including the surety bond or bonds to guarantee performance of the Work and insurance documentation, by 2:00 p.m. on Friday, February 24, 2023. 11. No bidder may withdraw his bid for a period of ninety (90) days after the date set for the opening of bids. The District reserves the right to reject any and all bids or to waive irregularities in any bid.
