Polk County, a political subdivision of the State of Florida, has received an unsolicited proposal submitted in accordance with the provisions of Section 255.065, Florida Statutes, Florida's Public-Private Partnership Act, for a proposed REGIONAL WATER QUALITY TREATMENT AND WETLAND RESTORATION PROJECT ("the Project") located in Polk County. The entity which has submitted the unsolicited Project proposal shall secure Project financing through publicly available funding sources and/or funding sources available to local governments in the state of Florida for the design, construction, operation, and maintenance of an approximate 400-acre water quality and wetland restoration project on private lands controlled by the entity making the proposal. The fee simple interest in the underlying real property, and ownership of the Project, shall be conveyed to the County upon the successful implementation and establishment of the proposed Project, following expiration of the proposed maintenance period. The Project shall treat excess surface water flows from Peace Creek and Saddle Creek basins, which have been identified by the State of Florida as "Impaired Waters". The Project shall also incorporate a natural, vegetated treatment system designed to remove Total Phosphorus (TP) and Total Nitrogen (TN) from the basin's surface water. Additionally, the Project shall provide restoration and enhancement of specified wetland functions and values including, but not limited to, stream restoration, wildlife habitat, and floodplain restoration. Under Florida's Public-Private Partnership Statute 255.065, Polk County is required to publish notice of the acceptance of an unsolicited proposal and a willingness to accept other proposals. Therefore, the County is hereby seeking qualified Respondents to prepare and submit proposals that address present and future water quality and other water resource enhancement/restoration objectives within the Peace Creek and Saddle Creek basins. As such, responsive proposals shall be required to address financing, design, construction, operation, and maintenance of an equivalent project, and project objectives, in terms of project size, water quality benefits, wetland restoration and enhancement benefits and floodplain restoration benefits on private lands controlled by a qualified Respondent submitting a proposal for County consideration within the Saddle Creek and Peace Creek basins that treats flows from surface waters from both basins via a natural vegetated treatment system. Proposals must provide reasonable assurances that the proposed project shall achieve annual TP and TN reductions, restore hydrology on historically agricultural lands, improve wildlife habitat and provide a measurable comprehensive environmental benefit to the basins. Respondents shall convey the property, and all improvements thereon, to the County upon the end of the proposed project agreement term. To be considered a qualified Respondent, the entity submitting a project proposal must have a demonstrated track record in the financing, design, construction, operation, and maintenance of regionally significant public water resource and water quality infrastructure projects, along with the capacity to bond the entire contract value through the end of the agreement term. Any entity that has an interest in submitting a competing proposal under the provisions of Section 255.065, Florida Statutes, is hereby invited to submit a proposal in compliance with the provisions of Section 255.065 Florida Statutes. Proposals that do not fully address each of the items required in this notice will be deemed "non-responsive". Proposals must be submitted in a "sealed" parcel or electronically through Polk County's secure website, Kiteworks. Proposals will be publicly opened at 2:00 p.m. on the receiving date. Sealed Parcel Submittal: If you are submitting a sealed parcel proposal submit one (1) original hard copy and (1) electronic copy of the proposal in a sealed parcel. The parcel should be labeled "Regional Water Quality Treatment & Wetland Restoration Project" and marked with the proposer's name and address. The Proposals may be mailed, expressed mailed or hand delivered to: Polk County Procurement Division 330 W. Church Street, RM 150 Bartow, FL 33830 863-534-6757 It is the Proposers responsibility to ensure their package is delivered to the Procurement Division prior to the Receiving date and time referenced above. Electronic Proposals Submittal: All prospective Proposers that are interested in submitting their proposals electronically can do so via the County's secure electronic submittal website, Kiteworks. Proposers must email Danielle Rose at daniellerose@polk-county.net at least 48 hours prior to opening to receive a link to upload their submittal. Only upload your document as a PDF and use the name convention for your file as follow: "Regional Water Quality Treatment & Wetland Restoration Project" For more instructions, a video tutorial can be produced by emailing Danielle Rose to further explain the electronic solicitation submittal process. Procurement recommends that proposers submitting electronically double check the documents submitted into Kiteworks to ensure information has been uploaded.
